BERMUDA AIR TERMINAL (FEES) AMENDMENT
REGULATIONS 2004

The Minister of Transport in exercise of the powers conferred
upon him by section 6 of the Civil Airports Act 1949, makes the following
regulations:

Citation
1 These Regulations may be cited as the Bermuda Air Terminal
(Fees) Amendment Regulations 2004.

Insertion of regulation 3A
2 The Bermuda Air Terminal (Fees) Regulations 1952 are amended
by inserting the following regulation next after regulation 3 —

"Waiver of fees under Air Service Incentives Programme
3A (1) Notwithstanding regulation 3(1), the General Manager
of Airport Operations may, subject to such directions as the
Minister may give, waive airport landing fees for a period not
exceeding six months for any one destination for airline flights
which qualify under the Air Service Incentives Programme.

(2) To qualify under the Air Service Incentives Programme
under paragraph (1) the airline must —

(a) have a scheduled airline service on a non-stop
routing to or from Bermuda to an unserved
destination;

(b) be certificated and possess the necessary
operating authority; and

(c) have entered into an agreement with the Ministry
of Transport stipulating the agreed terms and
incentives.".
