PUBLIC HEALTH AMENDMENT (NO. 2) ACT 2002

WHEREAS it is expedient to amend the Public Health Act 1949
to make provision for regulations governing the packaging and labelling
of food and other products, and the regulation of hospitals; and to
increase penalties for offences.
Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:
Citation
1 This Act, which amends the Public Health Act 1949 ("the
principal Act") may be cited as the Public Health Amendment (No. 2) Act
2002.
Amendment of section 156 of principal Act
2 Section 156 of the principal Act is amended by inserting after the
word "storage" the words ", packaging, labelling".
Amendment of section 161 of principal Act
3 Section 161 of the principal Act is amended by inserting in the
appropriate alphabetical place the following —
"hospital" means a facility in which accommodation is provided
on an in-patient basis, requiring a stay of more than 24
consecutive hours, for the diagnosis, treatment or care of
physical or mental conditions or maternity care, and includes

a hospital under the control of the Bermuda Hospitals
Board;".
Amendment of section 162 of principal Act
4 Section 162 of the principal Act is amended
(a) in the heading thereto, by inserting after the words
"maternity home" the words ", hospital";
(b) in subsection (1), by inserting after the words "maternity
home" the words "or hospital".
Amendment of section 163 of principal Act
5 Section 163 of the principal Act is amended —
(a) generally, by deleting the words "nursing home" or
"nursing homes" wherever they appear and by
substituting the words "maternity home" or "maternity
homes" respectively;
(b) in subsection (1), by deleting the word "and" after
paragraph (b) and inserting it after paragraph (c) and by
adding the following
"(d) a register of hospitals,";
(c) in subsection (2)(a) —
(i) by inserting after the words "nursing homes," the
word "hospitals,",
(ii) in subparagraph (i), by inserting after the word
"nursing home" the words ", hospital",
(iii) in subparagraph (iii), by inserting after the words
"nursing home" the words "a hospital";
(d) in subsection (2)(f), by inserting after the words "nursing
homes," the word "hospitals,";
(e) in subsection (2)(g) —
(i) by inserting after the words "nursing home" the
words "a hospital",
(ii) by inserting after the words "nursing home," the
words ", hospital";
(f) in subsection (3) —
(i) by inserting after the words "nursing home," the
words "a hospital",

(ii) by inserting after the words "nursing home" the
words ", hospital";
(g) in subsection (4)
(i) by inserting after the words "nursing home," the
words "a hospital",
(ii) by inserting after the words "the nursing home" the
words ", the hospital".
Amendment of section 164 of principal Act
6 Section 164 of the principal Act is amended —
(a) in the heading to the section, by deleting the words "and
diagnostic facilities" and substituting the words ", etc.";
(b) by inserting after the words "maternity home" where they
twice occur, the words ", hospital".
Insertion of new section 165A in principal Act
7 The principal Act is amended by inserting the following new
section —
"Packaging and labelling of products other than food
products
165A The Minister may make regulations imposing requirements
for the packaging and labelling of products made in Bermuda
other than food.".
Amendment of section 171 of principal Act
8 Section 171(1)(c) of the principal Act is amended by deleting
"$420", "$840" and "$84" and substituting "$3000", "$5000" and "$500"
respectively.
Amendment of section 175 of principal Act
9 Section 175 of the principal Act is amended by deleting "$168"
and substituting "$1000".
Amendment of section 186 of principal Act
10 Section 186 of the principal Act is amended by deleting "$168"
and "$840" and substituting "$1000" and "$5000" respectively.
Commencement
11 This Act comes into operation on such date as the Minister
responsible for health may appoint by notice published in the Gazette.
