MOTOR CAR AMENDMENT (NO 2) ACT 2001

WHEREAS it is expedient to amend the Motor Car Act 1951:

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:

Citation
1 This Act, which amends the Motor Car Act 1951, may be cited as
the Motor Car Amendment (No. 2) Act 2001.

Inserts new s. 53A in Motor Car Act 1951
2 The Motor Car Act 1951 is amended by inserting the following
new section after section 53—

"Satisfaction of emissions standards in connection with
motor car licences
53A (1) Without prejudice to section 54, a motor car licence shall
not be issued in respect of a motor car imported into Bermuda
after the coming into operation of this section unless the motor
car complies with approved emissions standards.

(2) The Minister may by order subject to the negative
resolution procedure—

(a) approve emissions standards for the purposes of
subsection (1);

(b) exempt any class of motor car from the requirements
of subsection (1).

(3) In this section—

"approved emissions standards" means such standards
as are approved by the Minister under subsection
(2)(a);

"motor car" includes motor cycles.".

Commencement
3 This Act comes into operation on such day as the Minister may
appoint by notice published in the Gazette.
