GOVERNMENT FEES AMENDMENT REGULATIONS 2000

The Minister of Finance, in exercise of the powers conferred on
him by section 2(1) of the Government Fees Act 1965 and every other
power vested in him, makes the following Regulations:

Citation
1 These Regulations may be cited as the Government Fees
Amendment Regulations 2000.

Revocation and replacement of Schedule to S.R.&O. 24/1976
2 The Schedule to the Government Fees Regulations 1976 is
revoked and the Schedule set out in the Schedule to these Regulations is
substituted.

Commencement and transitional
3 (1) Subject to paragraph (2), these Regulations commence on 1
April 2000 (“commencement day”).

(2) Nothing in these Regulations affects the validity or effect of a
fee that was paid―

(a) before commencement day; and

(b) in respect of a period that was still running on that day.

(6) Where a permission is granted for a period
less than that applied for, the relevant proportion of
the fee paid in accordance with categories (viii) to (xi) of
paragraph (4)(a), shall be refunded. Where no
permission of any kind is granted, then the fee paid
under categories (iii) to (v) and (vii) to (xi) of paragraph
(4)(a), less $110, shall be refunded.

(7) Where a permission is granted in
accordance with categories (viii) to (xi) of paragraph 4(a)
above and the work permit is cancelled before the
expiry date, there shall be refunded the relevant fee for
each whole year that remains unused on the date of
cancellation.

(8) Considering an application by a restricted
person or a trustee or grantee for the benefit of a
restricted person for a licence to hold or acquire land.



(Where a licence is granted under paragraph (9) the fee
specified in this paragraph shall be refunded to the
applicant.)

(9) Granting to a restricted person or to a
trustee or grantee for the benefit of a restricted
person―

(a) a licence to hold or acquire land―

(i) where the land is acquired by
devise or inheritance or by
voluntary conveyance

(ii) in any other case―

(A) where the land comprises a
condominium as defined by
section 2(2) of the Condo-
minimum Act 1986 and falls
within section 5 of the land
policy

(B) (where the land comprises a
residential unit in the
Morgan’s Harbour Develop-
ment

(C) in any other case



Where the licence referred to in sub-paragraph (a)(ii)
relates to land to be held or acquired by a restricted
person together with his Bermudian spouse

In any given case the fee paid under sub-paragraph (a)
(ii) less the fee payable under paragraph (8) is to be
refunded on the instruction of Cabinet.

apply means the total gross square footage of new construction,
including verandas and balconies, but excluding water tanks, outdoor
paved areas, patios and the like;

"accessory structures" include, but are not limited to, tennis courts,
parking areas, driveways, docks, walls, satellite dish receivers, signs,
piers, platforms, patios and like structures which do not result in the
creation of additional, enclosed floorspace, that are incidental to the
principal building and located on the same lot; and, for the avoidance of
doubt, a swimming pool is not an accessory structure and any separate
application for a pool shall be subject to the minimum fee set out in
either paragraph (1)(a)(i) or (2)(a)(i), whichever is applicable;

"re-inspection of works" means a re-inspection made because, at a
previous, scheduled visit to the works, either—

(a) conditions at the works prevented proper access to the
works; or

(b) the works did not meet the requirements of the Building
Code Regulations 1991; or

(c) the works for some other reason were not available or
ready for inspection; or

(d) a copy of the approved drawings was not available on-
site.

In the case of an existing building where the application relates to
building works designed specifically to provide access for, or otherwise
meet the needs of, the physically handicapped, no fee shall be charged.

In the case of alterations or extensions to a building listed as a building
of special architectural or historical interest in accordance with section
30 of the Development and Planning Act 1974, no fee shall be charged.
