ACT 2000

WHEREAS it is expedient to amend certain enactments in
consequence of the establishment of the Department of Parks;

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:

Short title
1 This Act may be cited as the Department of Parks (Consequential
Amendments) Act 2000.

Consequential amendments
2 The amendments set out in the Schedule, which are
consequential on the establishment of the Department of Parks, shall
have effect.

SCHEDULE
CONSEQUENTIAL AMENDMENTS

Summary Offences Act 1926

DEPARTMENT OF PARKS (CONSEQUENTIAL AMENDMENTS)
ACT 2000

1 In section 15 of the Summary Offences Act (riding horses on
beaches), for the words "Minister for the time being responsible for
agriculture and fisheries" in subsections (1) and (3), there shall in each
place be substituted "Minister for the time being responsible for parks".

Agriculture Act 1930

2 (1) In section 1 of the Agriculture Act 1930 (interpretation), for
the words "the Department of Agriculture, Fisheries and Parks" there
shall be substituted "the Department of Agriculture and Fisheries".

(2) Section 4(b) of that Act, (duty of Minister responsible for
agriculture and fisheries to clean and maintain parks and beaches etc)
shall be repealed.

(3) In section 5 of that Act (establishment of Department), for
the words "Department of Agriculture, Fisheries and Parks" in each of
the three places where they occur there shall be substituted "Department
of Agriculture and Fisheries".

(4) Section 56A of that Act (issue of permits for use of open
spaces for camping etc) shall be repealed.

Fisheries Act 1972

3 (1) In section 2 of the Fisheries Act 1972 (officers of
Department to be fisheries inspectors), for the words "Department of
Agriculture, Fisheries and Parks" there shall be substituted "Department
of Agriculture and Fisheries".

(2) In paragraph 1 of the Third Schedule to that Act (Director to
be member of Board), for the words "Director of Agriculture, Fisheries
and Parks" there shall be substituted "Director of Agriculture and
Fisheries".

Fisheries Regulations 1972

4 In regulation 1 of the Fisheries Regulations 1972 (interpretation),
for the words "Department of Agriculture, Fisheries and Parks" there
shall be substituted "Department of Agriculture and Fisheries".

Care and Protection of Animals Act 1975

5 In section 1 of the Care and Protection of Animals Act 1975
(interpretation), for the words "Department of Agriculture, Fisheries and
Parks" there shall be substituted "Department of Agriculture and
Fisheries".

Protection of Birds Act 1975

6 In section 1 of the Protection of Birds Act 1975 (interpretation)—

(a) for the words "Department of Agriculture, Fisheries and
Parks" there shall be substituted "Department of Parks";
and

(b) for the words "Minister responsible for agriculture and
fisheries" there shall be substituted "Minister responsible
for parks".

Endangered Animals and Plants Act 1976

7 In section 1 of the Endangered Animals and Plants Act 1976
(interpretation), for the words "Department of Agriculture, Fisheries and
Parks" there shall be substituted "Department of Agriculture and
Fisheries".

Bermuda National Parks Act 1986

8 (1) In section 2 of the Bermuda National Parks Act 1986
(interpretation), for the definition of "Department" there shall be
substituted—

" "Department" means the Department of Parks;".

(2) In section 8(2) of that Act (functions of the Director), after
paragraph (a) there shall be inserted—

"(aa) be responsible for the cleaning and maintenance of the
protected areas;".

Fisheries (Anti-Fouling Paints Prohibition) Regulations 1989

9 In regulation 2 of the Fisheries (Anti-Fouling Paints Prohibition)
Regulations 1989 (interpretation) for the words "Director of Agriculture,
Fisheries and Parks" there shall be substituted "Director of Agriculture
and Fisheries".
