THE BERKELEY INSTITUTE (PEMBROKE PARISH) SPECIAL
DEVELOPMENT ORDER 1999

In exercise of the powers conferred upon the Minister by section
15(2)(a) of the Development and Planning Act 1974, and all the powers
him hereunto enabling, the following Order is hereby made:

Citation
1 This Order may be cited as The Berkeley Institute (Pembroke
Parish) Special Development Order 1999.

Interpretation
2 (1) In this Order—

"the Act" means the Development and Planning Act 1974;

"the Board" means the Development Applications Board;

"conditions" means conditions specified in paragraph 3(2);

"the development" means the development referred to in the
planning application and more particularly described in the
First Schedule;

"the planning application" means the application for planning
permission for the development made by the Ministry of
Works & Engineering, numbered PLN: 843/98 and dated 6
October 1998, and the accompany drawings numbered ACAD

R-12; 1.00.01 and 02, 4.00.OA and OB, and 4.00.01 to 08
prepared by the Ministry of Works & Engineering;

"the site" means the land described in the Second Schedule.

(2) Subject to sub-paragraph (1), any expression used in this
order that is also used in the Act has the meaning assigned to it in the
Act.

Planning Permission
3 (1) Subject to the conditions specified in sub-paragraph (2),
planning permission is granted by this Order for the development of the
site.

(2) The conditions referred to in sub-paragraph (1) are as
follows:

(a) an application for a building permit shall be submitted
for approval by the Building Official prior to the
commencement of any construction work;

(b) the access road, driveway and parking areas shall be
designed, surfaced and graded to dispose of all surface
water run-off within the curtilage of the site and to avoid
the discharge of any excess water onto Berkeley Road or
any neighbouring property;

(c) prior to commencement of construction an application
showing detailed engineering drawings and cross
sections of the service road and parking areas and
illustrating the location of cut and fill, the proposed
gradients and materials to be used, shall be submitted
for the approval of the Board;

(d) prior to the commencement of construction, the Ministry
of Works and Engineering shall submit for the approval
of the Board a detailed landscaping scheme in
accordance with the provision of paragraph 6.13 of the
Board Planning Statement 1992.

Saving
4 For the avoidance of doubt, it is hereby declared that nothing in
this Order grants planning permission for any matters of development for
which planning permission is required, apart from any matter for which
planning permission has been granted by paragraph 3.

FIRST SCHEDULE (paragraph 2(1))

The Development

1. The development of a new secondary school, ancillary buildings,
a mechanical building and slat house, access road, driveway and
parking areas.

2. The development of 220,000 square feet of floorspace in abutting
two and three storey blocks arranged around an open
quadrangle, and in a separate gymnasium complex, including—

(a) in the eastern three-storey building—

(i) a cafeteria;

(i) a design and technology centre and classrooms;

(iii) drama, music and dance studios;

(iv) kitchens, bathrooms, maintenance, storage and
utility rooms;

(v) science laboratories and specialist classrooms;

(vi) a library and computer laboratory; and

(vii) offices, reception area and other ancillary
facilities; and

(b) in the western two-storey buildings—

(i) classrooms;

(ii) a visual arts centre; and

(iii) language laboratories, staffroom and other
ancillary facilities.

SECOND SCHEDULE (paragraph 2(1))

The Site

ALL THAT LAND in the Parish of Pembroke having an area of 5.67
hectares (14 acres) shown outlined in red on Drawing number 4.00.OA
accompanying the planning application.
