THE GOVERNMENT FEES AMENDMENT REGULATIONS 1998

In exercise of the powers conferred upon him by section 2(1) of
the Government Fees Act 1965, and every other power vested in him, the
Minister of Finance makes the following Regulations:

Citation
1 These Regulations may be cited as the Government Fees
Amendment Regulations 1998.

Revocation and replacement of Schedule to S.R.& O. 24/1976
2 The Schedule to the Government Fees Regulations 1976 is
revoked and the Schedule set out in the Schedule to these Regulations is
substituted.

Commencement and transitional
3 (1) Subject to paragraph (2), these Regulations commence on 1
April 1998 ("commencement day").

(2) Nothing in these Regulations affects the validity or effect of
a fee that was paid—

(a) before commencement day; and

(b) in respect of a period that was still running on that day.

(ii) to transfer such a person from one
occupation to another occupation

(iii) to change the job title of such a
person whose employer and duties

(5) Applying for a work permit, valid for such
period as may be specified in the permit, to employ
a person without Bermudian status who states in
writing that he or she —

(a) does not possess Bermudian status and
is a child, under the age of 22 years, of
a person who does possess Bermudian
status; or

(b) is the parent or lawful guardian of, and
has legal custody of, a person with
Bermudian status who is under 21
years of age and resides with him or her;
or

(c) was born in Bermuda and can
potentially qualify for the grant of
Bermudian status under section 20A; or

(d) first arrived in Bermuda before his or
her sixth birthday and can potentially
qualify for the grant of Bermudian
status under section 20A $64.00

(6) Where a permission is granted for a period
less than that applied for, the relevant proportion of
the fee paid in accordance with categories (viii) to
(xi) of paragraph (4)(a), shall be refunded. Where no
permission of any kind is granted, then the fee paid
under categories (iii) to (v) and (vii) to (xi) of
paragraph (4)(a), less $105, shall be refunded.

(7) Where a permission is granted in accor-
dance with categories (viii) to (xi) of paragraph (4)(a)
above and the work permit is cancelled before the
expiry date, there shall be refunded the relevant fee
for each whole year that remains unused on the
date of cancellation.

(8) Considering an application by a restricted
person or a trustee or grantee for the benefit of a
restricted person for a licence to hold or acquire
land $1,045.00

(Where a licence is issued under paragraph (9) the
fee specified in this paragraph shall be refunded to
the applicant.)

(9) Issuing to a restricted person or to a
trustee or grantee for the benefit of a restricted
person:

(a) a licence to hold or acquire land—

(i) where the land is acquired by
devise or inheritance or by
voluntary conveyance $1,045.00

(ii) in any other case—

(A) where the land comprises a
condominium as defined by
section 2(2) of the Condo-
minium Act 1986 and falls within section 5 of the land policy

building permit fee applicable under
paragraph (2)(a)(i) $200.00

(5) In all cases where the building operations commence prior to the
issue of the required permits listed above, an additional fee of $300 will
be charged.

(6) Under this item —

For the purposes of calculating the building permit fee in
accordance with paragraphs (1)(a)(i) and (2)(a)(i), the floorspace to which
the fee shall apply means the total square footage of new construction,
including verandas and balconies, but excluding outdoor paved areas,
patios and the like;

"accessory structures" include, but are not limited to, tennis
courts, parking areas, driveways, docks, walls, satellite dish receivers,
signs, piers, platforms, patios and like structures which do not result in
the creation of additional, enclosed floorspace, that are incidental to the
principal building and located on the same lot; and, for the avoidance of
doubt, a swimming pool is not an accessory structure and any separate
application for a pool shall be subject to the minimum fee set out in
either paragraph (1)(a)(i) or (2)(a)(i), whichever is applicable;

"re-inspection of works" means a re-inspection made necessary
because, at a previous, scheduled visit to the works, either—

(a) conditions at the works prevented proper access to the
works; or

(b) the works did not meet the requirements of the Bermuda
Building Code; or

(c) the works for some other reason were not available or ready
for inspection; or

(d) a copy of the approved drawings was not available on-site.

Provided that, in the case of an existing building where the
application relates to building works designed specifically to provide
access for, or otherwise meet the needs of, the physically handicapped,
no fee shall be charged; and

Provided that, in the case of alterations or extensions to a
building listed as a building of special architectural or historical interest
in accordance with section 30 of the Development and Planning Act
1974, no fee shall be charged.

Head 8
Building Authority Act 1962

(1) Issuing a permit or licence under the
Building Authority (Petroleum) Regulations 1962—

(a) to possess, offer for sale, or store in
excess of 10 gallons (45 litres) of, or to
use a portable tank for the
transportation of, dangerous petroleum
under regulation 2 $190.00

(b) to maintain or operate an installation
for bulk storage of petroleum gases $440.00

(c) to possess and offer for sale ordinary
petroleum in excess of 275 gallons
(1250 litres) per regulation 17 save that
no further fee shall be required from
the holder of a subsisting permit or
licence issued under sub-paragraph (a) $60.00

(2) Issuing a permit to operate under regulation
4 of the Building Authority (Elevators and Lifts)
Regulations 1962—

(a) site coverage of proposed development
is less than 4,000 sq. ft. $140.00

For the purpose of this paragraph an
applicant is exempted from payment of the fee where
his application involves—

(a) alterations or extensions to a building
listed as a building of special
architectural or historical interest in
accordance with section 30 of the Act;

(b) alterations or extensions to a building,
or the construction of a new dwelling,
designed specifically to meet the needs
of the physically challenged; or

(c) the submission of a revised application
following the withdrawal or refusal of a
previous application, provided the
revised application is submitted within
twelve months and only one exemption
per site is allowed.

(3) Upon submission of an application for the
renewal of planning permission in accordance with
rule 9 of the Development and Planning (Application
Procedure) Rules 1997 $60.00

(4) Applying for planning permission pursuant
to Part IV or Part X of the Act for all forms of
development commenced before final approval is
granted an additional fee will be charged $300.00

(5) Applying for the subdivision of land pur-
suant to Part VI of the Act where the application is—

(a) to alter lot boundaries where no
additional lots are created—

(i) upon applying $140.00

(ii) upon final approval NIL

(b) to create one additional lot—

(i) upon applying for approval of a
draft plan $140.00

(ii) upon applying for approval of final

(c) to create 2 to 4 additional lots—

(a) Upon lodging any notice of appeal to

For the purposes of the above paragraphs, the fees
are to be charged on the basis of the development for
which planning permission is being sought and any
development for which planning permission has
previously been granted shall not be included in
calculating the fee.

Dogs Act 1978

(1) Issuing a dog licence under section 4(1)—

for each repeater station (if any) to the licence fee for
the base and mobile stations in accordance with the
