HUMAN RIGHTS AMENDMENT ACT 1998

[Operative Date 29 July 1998]

WHEREAS it is expedient to amend the Human Rights Act 1981:

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:

Citation
1 This Act may be cited as the Human Rights Amendment Act
1998.

Amendment of section 6 of Human Rights Act
2 Section 6(1) of the Human Rights Act 1981 is amended by
inserting after paragraph (b) the following new paragraph—

"(bb) paying one employee at a rate of pay less than the rate of
pay paid to another employee employed by him for
substantially the same work, the performance of which
requires equal education, skill, experience, effort and
responsibility and which is performed under the same or
substantially similar working conditions, except where
the payments are made pursuant to—

(i) a seniority system;

(ii) a merit system; or

(iii) a system that measures earnings by quantity or
quality of production or performance;".

Commencement
3 This Act comes into force on such date as the Minister may
appoint by notice published in the Gazette.
