CUSTOMS TARIFF AMENDMENT ACT 1998

[Operative Date 18 February 1998]

WHEREAS it is expedient to amend the Customs Tariff Act 1970:

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:

Citation
1 This Act which amends the Customs Tariff Act 1970 (hereinafter
referred to as "the principal Act") may be cited as the Customs Tariff
Amendment Act 1998.

Interpretation
2 In this Act "the commencement date" means 18 February 1998.

Amends First Schedule to principal Act
3 The First Schedule to the principal Act is amended—

(a) in SECTION TEN, by inserting next after item 48.000,
the following item—

"48.0050 Incontinence

CUSTOMS TARIFF AMENDMENT ACT 1998

aids value 10.00%";

(b) in SECTION ELEVEN, by inserting next after item
63.000, the following item—

"63.0050 Table coverings and
accessories made
of linen value 6.5%"; and

(c) in SECTION SIXTEEN, by inserting next after item
84.7100 the following item—

"84.7125 Portable computers,
parts and accessories
purchased under
school programmes
certified by the
Chief Education
Officer for use only
by registered full-
time students value 5.0%.".

Amends Third Schedule to principal Act
4 The Third Schedule to the principal Act is amended by deleting
all the words beginning with "Oil, bunker" and ending with
"government)." and substituting the following—

"Oil, bunker, fuel and diesel except for—

(a) oil supplied to Her Majesty's ships or aircraft;

(b) ships or aircraft having commission from any foreign
government; and

(c) ex-bonded fuels provided to commercial customers but
then returned as unsatisfactory and subsequently
exported.".

Amends Fifth Schedule to principal Act
5 The Fifth Schedule to the principal Act is amended—

(a) in section A—

(i) in item 1 by inserting next after the words
"Agricultural equipment" wherever they appear,
the words "and parts";

(ii) in item 3 by inserting next after the word
"equipment" wherever it appears, the words "and
parts";

(b) in section D, in item 2, in the second column, by
deleting all the words beginning with "Hospital
equipment" and ending with "member of staff" and
substituting the following—

"Hospital equipment, accessories and spare
parts thereof given or bequeathed for the
purposes of the hospital or purchased for the
hospital with moneys donated into the
Endowment and Donation Fund, being a fund
established by the Bermuda Hospitals Board to
receive funds or gifts for such purposes,
pursuant to section 15 of the Bermuda Hospitals
Board Act 1970, and instruments and
equipment bona fide imported for the use of a
visiting consultant member of the medical staff
of the hospitals, subject to such instruments
and equipment being exported on the conclusion
of the visit of the consultant member of the
medical staff."; and

(c) in Section K, by deleting item 27 and substituting the
following new item—

"National 27 All construction mater-
Sports ial, building supplies
Centre and finishing materials

used in the construc-
ion of the National
Sports Centre and the
initial investment in
equipment needed to
make the center opera-
tional.".

Commencement
6 This Act is deemed to have come into operation on the
commencement date.
