NATIONAL SPORTS CENTRE TRUSTEES AMENDMENT ACT
1995

[Date of Assent 22 December 1995]

[Operative Date 1 April 1996]

WHEREAS it is expedient to amend the National Sports Centre
Trustees Act 1988:

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:

Short title
1 This Act may be cited as the National Sports Centre Trustees
Amendment Act 1995.

Amendment of s 2 of Act No 5 of 1988
2 Section 2 of the National Sports Centre Trustees Act 1988 ("the
Act") is amended by deleting the definition of "the Centre" and
substituting the following definition—

" "the Centre" means the centre at Prospect in the Parish of
Devonshire—

(a) known as the National Sports Centre; and

(b) consisting of land, together with buildings erected on,
and equipment, furniture and effects appurtenant to,
that land;".

Insertion of new s 6A in Act
3 There is inserted in the Act next after section 6 the following
section—

"Vesting of the Centre
6A (1) Subject to subsection (2), all the land, buildings,
equipment, furniture and effects which immediately before the
date of commencement of the National Sports Centre Trustees
Amendment Act 1995 constituted or were part of the Centre (as
then defined) are by virtue of this subsection and without further
assurance vested in the Trustees to be held by them to the
extent and subject to any conditions to or subject to which they
were held by the Government immediately before that date.

(2) The Trustees shall not sell or otherwise dispose of
any land that is vested in them except with the prior written
approval of the Minister and the Minister of Finance.".

Repeal and replacement of s 10 of Act
4 (1) Section 10 of the Act is repealed and the following section is
substituted—

"Borrowing
10 (1) Subject to subsection (3), the Trustees may borrow
from the Government or from any other person any money that
they may require for the purpose of discharging any of their
functions under this Act or of meeting their obligations.

(2) Subject to subsection (3), the repayment of any
money borrowed under subsection (1) may be secured upon the
property of the Trustees by the issue by them of debentures or
debenture stock or otherwise.

(3) The Trustees shall not exercise any of their powers
under this section except with the prior written approval of the
Minister and the Minister of Finance.".

Amendment of s 14 of Act
5 Section 14 of the Act is amended by deleting "employment" and
substituting "payroll".

Miscellaneous amendments to Act
6 The sections of the Act specified in the first column of the
Schedule to this Act have effect subject to the amendments respectively
specified in the second column of that Schedule, being minor
amendments consequential on or incidental to the amendments made to
the Act by sections 2 and 3 of this Act.

Commencement
7 This Act comes into operation on 1 April 1996.

SCHEDULE (Section 6)

Consequential or Incidental Amendments to the Act

Sections 7 and 8: delete the words "National Sports" from the
headnotes;

Section 11: (a) in paragraph (a), insert "written"
immediately before "approval";

(b) in paragraph (b), insert "written"
immediately before "instructions"
wherever the latter word appears;

Section 12: (a) in subsection (1), delete "the operation
of the Centre and the" and substitute
"their operations, and those";

(b) in subsection (3), delete "Centre" and
substitute "Trustees";

Section 13: in subsection (2), delete "Centre" and
substitute "Trustees".
