DEVELOPMENT AND PLANNING (BERMUDA PLAN 1992
EXTENSION) ACT 1993

WHEREAS it is provided by section 10 of the Development and
Planning Act 1974 ("section 10")—

(a) that the Minister may by notice published in the Gazette,
prior to the approval of a development plan by the
Legislature under that Act, declare a draft development
plan operative as a development plan from such date as
may be specified in the notice and until that approval is
obtained; but

(b) that, if that approval is not obtained within eighteen
months of the publication of such a notice, a draft
development plan so published shall cease to be so
operative:

AND WHEREAS the Minister of the Environment, by a notice
published in the Gazette on 3 July 1992 under section 10, declared the
Bermuda Plan 1992 operative from that date:

AND WHEREAS it is expedient, in the events which have since
that time occurred, that the operation of the Bermuda Plan 1992 under
section 10 should be extended beyond the period of eighteen months
after its publication in the Gazette, notwithstanding the restriction in
that behalf imposed by section 10:

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same as follows:—

Short title
1 This Act may be cited as the Development and Planning
(Bermuda Plan 1992 Extension) Act 1993.

Extension of operation of Bermuda Plan 1992
2 Notwithstanding the proviso to subsection (1) of section 10 of the
Development and Planning Act 1974, the Bermuda Plan 1992 shall
continue operative under that section as a development plan until 2 July
1994.
