BROADCASTING COMMISSIONERS AMENDMENT ACT 1993

WHEREAS it is expedient to amend the Broadcasting
Commissioners Amendment Act 1953;

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:

Short title
1 This Act which amends the Broadcasting Commissioners Act,
1953 may be cited as the Broadcasting Commissioners Amendment Act
1993.

Amendments
2 The Broadcasting Commissioners Act 1953 is amended as
follows:

(a) in section 1, delete the definition of the expression
"broadcasting undertaking" and insert in correct
alphabetical order the following definitions:

' "broadcasting" means the act of transmitting or re-
transmitting radiocommunications intended for
direct reception and use by any member of the
public without charge and cognate expressions
shall be construed accordingly;

"broadcasting undertaking" means any undertaking
carrying on the business of broadcasting;';

(b) in section 8(1), insert immediately after the word
"person" the words "or which is likely to violate this Act
or any regulations or directions made thereunder" and
insert immediately after the word "aforesaid" the words
"or which violates this Act or any regulations or
directions made thereunder";

(c) in section 10(2), for the words "commits an offence"
substitute the words "shall be guilty of an offence";

(d) in section 11—

(i) in subsection (1)—

(A) delete all the words immediately after the
words "make regulations";

(B) delete the words "as to" wherever they
appear in paragraphs (a) to (f) inclusive;

(C) in paragraph (a), insert immediately before
the words "the submission" the word
"regulating";

(D) in paragraph (b), insert immediately before
the words "the times" the words
"prohibiting or regulating" and insert
immediately after the word "broadcast" the
words "or prohibiting or regulating the
broadcast of advertisements relating to
particular goods or classes of goods";

(E) in paragraph (c), insert immediately before
the words "the times" the words
"prohibiting or regulating";

(F) paragraph (d), insert immediately before
the words "the maximum" the word
"regulating";

(G) in paragraph (e), insert immediately before
the words "the minimum" the words
"providing for the classification of any
programme or other matter that is to be
broadcast and regulating"; for the words
"programmes of minority, cultural or
educational interest" substitute the words

"any programme or other matter that is
classified"; and for the words "programmes
or a proportion of them" substitute the
words "programme or other matter or a
proportion thereof";

(H) in paragraph (f), insert immediately before
the words "the inspection" the word
"regulating";

(I) insert immediately after paragraph (f) the
following:

"(g)prohibiting or regulating any
programme soliciting funds from
members of the public;

(h) regulating the transmission of
programmes or other matters prior to
the broadcasting thereof and the
keeping of a record of such
transmission;";

(J) re-letter paragraph (g) as paragraph (i);

(ii) in subsection (2), for the figure "1,440"
substitute the figure "5,000".
