SUPPLIES CONTROL (CONTROLLER OF SUPPLIES) REGULATIONS

(Section 3(1))

[13th June, 1998]

1. These Regulations may be cited as the

SUPPLIES CONTROL (CONTROLLER OF SUPPLIES) REGULATIONS.

2. A person shall be appointed as the Controller of Supplies by the Public Services Commission.

3. A person appointed as Controller of Supplies shall be selected from public officers currently employed in the Public Service.

4. These Regulations shall come into force on the 8th day of June, 1998.

CHAPTER 293

SUPPLIES CONTROL (DISTRIBUTION OF RICE) REGULATIONS

(Section 3)

[1st June, 1985]

1. These Regulations may be cited as the

SUPPLIES CONTROL (DISTRIBUTION OF RICE) REGULATIONS.

2. It shall be an offence for any person or persons to sell, distribute or otherwise deal in rice without prior authority of the Minister where the sale or distribution is a wholesale transaction.

3. The Controller of Supplies may grant permission in writing to any person or body of persons to sell, distribute or otherwise deal in rice, subject to such terms and conditions as he shall think fit.

4. Where the Minister is of opinion that the circumstances require it, he may take over any stocks of rice in possession or control of any producer, manufacturer or trader to ensure the equitable distribution thereof.

5. Where the Minister decides under Regulation 4 above any stocks of rice should be taken over, he shall so inform the manufacturer, producer or trader concerned in writing on or before the time of such take over.

6. The writing required to be given by the Minister under Regulation 5 above may stipulate that the manufacturer, producer or trader concerned shall perform such acts as the Minister thinks necessary to facilitate the take over of the stocks concerned.

7. Where any stocks are taken over by the Minister under Regulation 4, above, the manufacturer, producer or trader concerned shall be paid the controlled price for the said stocks of rice:

Providing always that where any cost is incurred in the transport at landing of such stocks, the Minister shall be entitled to deduct such costs from the price to be paid to the manufacturer, producer or trader concerned.

CHAPTER 293

SUPPLIES CONTROL (IMPORT/EXPORT) REGULATIONS

(Section 3)

[12th November, 1988]

1. These Regulations may be cited as the

SUPPLIES CONTROL (IMPORT/EXPORT) REGULATIONS.

2. In these Regulations, unless the context otherwise requires -

“Belize” includes the territorial waters of Belize;

“export” with its grammatical variations and cognate expressions means taking out of Belize to a place outside Belize;

“goods” means goods listed in the First and Second Schedules to these Regulations;

“import” with its grammatical variations and cognate expressions, means bringing into Belize from a place outside Belize;

“premises” includes any warehouse, shop, vehicle, hotel, vessel or cart;

“senior price control officer” means a person appointed to assist the Controller of Supplies in carrying out the provisions of these and any other Regulations made under the Supplies (Control) Act, and includes a Price Control Officer;

“records” includes any invoice, licence, bill of sale, customs entry or any other

3. (1) It shall be an offence for any person to import or attempt to import into, or export or attempt to export from Belize any of the goods listed in the First and Second Schedules to these Regulations respectively, save under or in accordance with the provisions of a licence issued by the Controller of Supplies or some officer duly authorised by him:

Provided that the First Schedule to these Regulations shall not apply to the goods imported from any of the countries of the Caribbean Community, and in respect of such countries, Regulation 3(i) above shall have effect in relation to the goods specified in the Fifth Schedule hereto insofar as such goods are of Caricom Market Origin.

(2) The importer of any goods sold whether for cash or credit, shall in every case, forthwith furnish the purchaser with an invoice on which he shall set out a full description of such goods, the quantity, the size, the brand, the price, the date of such transaction, the name and address of the importer and the purchaser, the number of Customs entry receipt and failure to furnish such invoice and particulars shall be an offence under these Regulations.

(3) Any person found in possession of goods shall at all times keep records showing particulars of acquisition, purchase and import of such goods so as to enable any person authorised by the Controller of Supplies, readily to trace the importation of such goods and failure to keep such records, shall be an offence under these Regulations.

(4) The licence issued for the importation of goods shall be in the form set forth in the Third Schedule and the licence issued for the exportation of goods shall be in the form set forth in the Fourth Schedule.

(5) The Controller of Supplies or any person authorised by the Controller of Supplies, or a police officer may, at any reasonable time, enter any premises in which goods are kept, stored or offered for sale and inspect

such goods and records relating thereto.

(6) The Controller of Supplies or some other officer duly authorised by him may attach to any licence issued under Regulation 3(iv) such terms and conditions as he may deem fit.

(7) Any person who contravenes any of the terms and conditions stipulated in any licence issued by the Controller of Supplies or by some other officer duly authorised by him shall be guilty of an offence.

4. (1) It shall be lawful for the Controller of Supplies, Senior Price Control Officer, Price Control Officer or officer of Customs to take possession of any goods which he has cause to suspect were imported or an attempt was being made to import or export them other than under and in accordance with the provisions of a licence issued by the Controller of Supplies and shall take the same before a Magistrate.

(2) The Magistrate before whom such goods are brought shall forthwith inquire whether the officer who took the goods into possession had reasonable cause for so doing and if the suspicion of the officer appears to him to have been reasonable, he shall direct that the person in whose possession the goods were found or the owner thereof or any person making claim thereto or all of them, be summoned to appear before him at such time and place as to him shall seem appropriate to show cause why the goods should not be forfeited.

(3) After hearing the accounts of the person or persons so summoned and their witnesses and after examining other supporting evidence the Magistrate if he is satisfied that the goods were imported or an attempt was being made to import or export them lawfully shall order the return of the same to the person entitled to possession thereof, and if he is not so satisfied he shall order the same forfeited and shall direct that the same be delivered to the Controller of Supplies who shall dispose of them in such manner as he shall deem fit.

5. (1) Notwithstanding that a Magistrate has made an order under the provisions of paragraph 3 of Regulation 4 in respect of any goods, any person who imported or attempted to import or export such articles or goods in contravention of these Regulations shall be liable to punishment under section 4 of the Supplies Control Act.

(2) Any person in possession of goods for which a licence is required shall if he is unable to produce a licence, bill of sale or other document to the satisfaction of the Magistrate forfeit such goods and the Magistrate shall direct that the same be delivered to the Controller of Supplies who shall dispose of them in such manner as he shall deem fit.

6. The burden of proving that a licence has been issued shall be on the person alleging the same.

7. Any information and complaint in respect of any contravention of any of these Regulations may be laid by the Controller of Supplies, the Senior Price Control Officer, a Price Control Officer, or a Police Officer.

CHAPTER 293

SUPPLIES CONTROL (PRICES) REGULATIONS (Section 3)

[4th April, 1987]

1. These Regulations may be cited as the

SUPPLIES CONTROL (PRICES) REGULATIONS.

2. (1) In these Regulations unless otherwise stated or the context otherwise requires -

“Import” means to bring or be concerned in bringing into the country or the territorial waters thereof, and “importation” shall be construed accordingly;

“landed cost” in relation to any goods means the aggregate of the following amounts, namely -

(a) the C.I.F. value thereof at the port of entry,

(b) the Customs and stamp duties payable thereon,

(c) an additional sum for cartage but not exceeding 2% of the total amounts referred to at (a) and (b) above as may appear reasonable to the Controller of Supplies,

(d) bank charges (excluding bank interest),

(e) port charges (excluding warehouse rent);

“price-controlled goods” means goods or articles listed under the regulations where a maximum price has been fixed as well as price-regulated goods of any description;

“price control officer” means a person appointed to assist the Controller of Supplies in carrying out the provisions of these and any other regulations made under the Supplies Control Act and includes a Senior Price Control Officer;

“retail” means the sale of goods in any quantity less than the quantity specified in the definition of “wholesale” in these Regulations;

“retailer” in relation to any description of goods means a person who sells goods of that description by retail;

“trader” means every merchant, shopkeeper, storekeeper and person engaged in trade and includes any partnership, firm, or incorporated company engaged in trade;

“vendor” has the same meaning given to a trader in these Regulations;

“wholesale” means the sale of goods relating to -

(a) as regards goods in respect of which a wholesale unit is specified in the First or Second Schedule thereto, any quantity not less than such wholesale unit;

(b) as regards other goods, any quantity not less than that contained in the smallest package in which such goods are ordinarily sold by wholesalers to retailers or if such goods are not ordinarily sold in packages by wholesalers to retailers, the smallest quantity of such goods which is ordinarily sold by wholesalers to retailers;

“wholesaler” in relation to any description of goods means a person who sells goods of that description by wholesale.

(2) References in these Regulations to a trader, vendor, wholesaler, retailer or a person carrying on a business include references to a person employed to sell or otherwise deal in goods by the person carrying on the business or by the trader, vendor wholesaler, or retailer.

(3) In these Regulations unless otherwise stated or the context otherwise stated or the context otherwise requires, reference to a sale includes an agreement to sell, or a notification by a person of the price proposed by him for the sale of goods made by the publication of such price by exposing the goods for sale in association with a mark indicating such price, by furnishing of a quotation or otherwise, shall be a sale of such goods.

(4) For the purpose of these Regulations, a person shall be deemed to sell goods if he is the owner of, or carries on a business in the course of which such goods are sold, whether or not the sale be effected by him personally or through an agent or employer, an agent or employee effecting sale on behalf of this principal, owner or employer shall also be deemed to sell such goods.

3. Subject to the provisions of these Regulations -

(1) The maximum wholesale and retail prices of goods enumerated in any part of the First or Second Schedule shall be arrived at by adding the maximum percentage indicated therein, in the case of goods for which percentage mark-ups are indicated.

(2) The maximum wholesale and retail prices of goods enumerated in any part of the First or Second Schedule shall be arrived at by adding the designated mark-up, in the case of goods for which a specific monetary mark-up is indicated.

in any part of the First or Second Schedule shall be the prices set out against such goods, in the case of goods for which a specific maximum price is indicated.

(4) If any goods are listed in more than one part of the First Schedule or can be classified under a description of goods on which the maximum wholesale or retail prices are arrived at variously by adding a percentage mark- up, or by a specific price, then the maximum wholesale or retail price shall be the lesser of any of these prices.

(5) The controlled wholesale or retail price of any particular quantity or of any particular description of goods specified in the First or Second Schedule to these Regulations shall be deemed to apply in the same proportion to any greater or less quantity than wholesale (in the case of sale by retail) or to any other description or package of any such goods (in cases of sale by wholesale or retail).

(6) References in the First or Second Schedule to size of packages or to weight volume or numerical content of containers in relation to any goods shall be construed so that any variation of these factors shall not render any such goods to be outside these Regulations, but these variations shall be taken into account in arriving at the maximum wholesale or retail price by proportional increase or decrease as the case may be.

Provided that in the case of Bread, no person shall charge more than the maximum retail price specified in the Second Schedule irrespective of the fact that the loaf weighs more than the weight specified in the said schedule.

(7) The controlled retail prices of goods indicated in any Part of the First Schedule may be increased, -

(a) in the case of goods other than Butane (Domestic) Gas, sold at any place outside a two mile radius of Belize City, by such amount as represents a proportional price of any freight charges incurred

in transporting such goods form the place of sale and as appear reasonable to the Controller of Supplies;

(b) in the case of Butane (Domestic) Gas, by a delivery fee of $2.00.

4. Where in any part of the First or Second Schedule the maximum retail price is given by reference to a particular method of sale, whether by pound, by board foot, by article or otherwise, it shall be an offence for the retail price to be computed otherwise than in accordance with the method stated.

5. (1) All or any price-controlled goods offered for sale by auction shall be subject to the maximum prices applicable to the particular articles and no price-controlled goods may be sold by an auctioneer unless the person at whose request the auction is held has notified such auctioneer in writing of the maximum wholesale or retail price at which such goods may be sold under these Regulations, and the auctioneer shall not accept any bid or knockdown any such goods at a price in excess of the maximum wholesale or retail price (as the case may be) thus notified to him.

(2) Any person who, when making the notification referred to in the preceding sub-paragraph, fails in any way to state the correct maximum prices of the particular goods shall be guilty of an offence against these Regulations.

6. Notwithstanding the provisions of these Regulations, the holder of a stock of identical goods which may have been received on different consignments and at varying prices, may, with the consent of the Controller of Supplies, fix an average price for such goods and the price approved by the Controller of Supplies shall be the maximum wholesale or retail (price as the case may be) for such goods.

the permitted additional cartage mark-up under Regulation 3 (7) of any price-controlled goods would, but for this paragraph, include a fraction of one cent, then in calculating such landed cost or percentage mark-up, or permitted additional cartage mark-up -

(a) if the fraction is less than half of one cent, it shall be omitted;

(b) if the fraction is half of one cent or more, it shall count as one cent.

8. Except with the written permission of the Controller of Supplies no person shall, in connection with any sale of price controlled goods, impose or attempt to impose any conditions as to the purchase of any other goods, or as to the giving of any consideration other than the permitted purchase price.

9. (1) No wholesaler shall refuse, without reasonable cause, to sell any price-controlled goods by wholesale to any retailer who carries on a business in any such goods if immediate payment of the maximum permitted price is tendered.

(2) No retailer shall refuse, without reasonable cause to sell by retail any reasonable quantity of price-controlled goods demanded by an intended purchaser who tenders immediate payment to the maximum price therefor.

(3) A vendor shall be deemed to refuse without reasonable cause to sell any goods if he falsely denies that he has such goods, or uses any words, or gives any other indication, calculated to lead a person who wishes to buy such goods to suppose erroneously that such vendor has not such goods.

10. (1) No person shall, without written permission granted by or on behalf of the Controller of Supplies, or otherwise than in accordance with the conditions attached to such permission (if granted) sell or buy, or agree to sell or buy, or attempt or offer to sell or buy, any price-controlled goods mentioned

in any part of the First or Second Schedule hereto at a price higher than the maximum selling price permitted by these Regulations, or otherwise in contravention of these Regulations, or any conditions or requirements imposed, thereunder.

(2) This regulation shall apply –

(a) to goods for exportation by the buyer or prospective buyer; or

(b) to the buying of goods, or to the agreeing or offering to buy goods by a person acting as an “Agent Provacateur” being the Controller of Supplies, the Senior Price Controller Officer, a price control officer, a police officer, or a person acting by direction of any such persons.

11. Except with the written permission of the Controller of Supplies it shall be an offence for an importer to sell any price-controlled goods imported by him unless he has submitted a cost sheet and customs-entry in accordance with Regulation 22 of these Regulations and has received the checked and approved copy from the office of the Controller of Supplies.

12. (1) In any proceedings taken or instituted under these Regulations, any of the following averments shall be sufficient without proof of any such fact, unless the defendant in such proceedings proves to the contrary-

(a) that any person is a Price Control Officer

(b) that goods are of a class or description controlled under some specified provision of these Regulations;

(c) that the maximum or minimum permitted price of

goods are stated in the information or complaint;

(d) that a certain quantity of certain goods are subject of sale by “wholesale” or by “retail” as the case may be;

(e) that certain goods are from a particular shipment or shipments or that they were imported on or before a stated date.

(2) The burden of proving that a case comes within any exception described in these Regulations shall be on the person alleging the same.

(3) The burden of proving that the price at which goods were sold or bought, as the case may be, was not in contravention of the price as regulated or sanctioned by these Regulations shall be on the person alleging the same.

(4) When any goods are found on the business premises of a vendor, the onus of proving that such goods are not on such premises for the purpose of sale shall be on the vendor.

(5) A cost sheet showing the price of imported goods, the date of importation, the importer, and all other matters as contained in a cost sheet under the Third Schedule to these Regulations shall be admissible in evidence without proof of the signature of the Controller of Supplies, a price control officer or persons authorised by the Controller of Supplies and shall be Prima facie evidence of the truth of all matters therein contained.

(6) A certificate signed by the Controller of Supplies certifying that goods are of a class or description controlled under some specified provision of these Regulations, and certifying the maximum permitted price thereof, shall be prima facie evidence in all Courts of justice and for all purposes of the facts therein certified, without the necessity of adducing proof of the signature appearing or such certificate, and the burden of proving that the price at which

goods were sold or bought, as the case may be, was not in excess of the price as regulated or sanctioned by these Regulations, shall be on the person alleging the same.

(7) Any fact of which oral evidence may be given in any proceeding under these Regulations may be admitted for the purpose of those proceedings by or on behalf of the prosecution or defendant, and the admission by any party of any such fact under this section shall as against that party be conclusive evidence in those proceedings of the fact admitted.

13. The vendors of any price-controlled goods sold whether for cash or credit shall in every case where the sale is by retail, forthwith furnish the purchaser with a bill on which he shall set out a full description of such goods, the quantity sold and date of such transaction, the name and address of the vendor and the purchaser, the price at which the goods are being sold, and where the sale is by wholesale the maximum retail price at which such goods should be sold.

14. Every trader of any price-controlled goods shall keep a record of all particulars relating to the cost of goods imported or otherwise purchased by him, so as to enable the Controller of Supplies, a price control officer, a police officer or any person authorised by the Controller of Supplies readily to trace the landed cost or the cost of acquiring such goods, and failure to keep such record shall be an offence under these Regulations.

15. Every retailer of any price-controlled goods for which a specific price is set out in any part of the First or Second Schedule to these Regulations shall keep posted up in public view in some conspicuous place in his business premises a list in good and readable condition showing the approved maximum retail prices of such goods as shall from time to time be prescribed, and failure to indicate prices of such goods shall be an offence under these Regulations.

16. Every retailer having price-controlled goods in his or her possession for the purpose of sale shall clearly mark on such goods or on the wrapping or

containers of such goods, or on a tag affixed to such goods in such manner as to be clearly identifiable with the goods to which it relates, the retail prices at which such goods are offered for sale, in such manner as to be easily seen and read by any person entering his or her business premises.

Provided that it shall not be necessary to mark any goods appearing in a price list in accordance with the immediate foregoing regulation.

16:01 Every trader whether wholesaler or retailer, who sells or has in his possession for the purpose of sale for local consumption, any goods enumerated in the Fourth Schedule to these Regulations shall ensure that such goods are clearly marked on the wrappings or containers of such goods or on a tag affixed to such goods with the words “Belize Market” in such a manner as to be easily seen by any person purchasing them; and a failure to ensure that the goods are marked in accordance with the foregoing provisions of this Regulation shall be an offence under these Regulations.

17. Whenever a trader possesses stocks of any price-controlled goods of which there is otherwise a shortage in the local market, the Controller of Supplies may, without requisitioning such goods, by order in writing require such trader to sell to such persons as shall be named in the order, the quantities therein specified of such goods by a time to be specified in the order and upon tender of immediate payment the maximum permitted price of the quantities of goods so specified such trader shall sell such quantities in accordance with the order. Any trader who without reasonable excuse, fails to comply with the order of the Controller of Supplies upon tender of the purchase price by a purchaser named in the order, shall be guilty of an offence under these Regulations.

18. (1) Any person authorised by the Controller of Supplies shall be and is hereby empowered to demand and take possession of evidence either by way of articles, invoices, books or other documents, or by such information as may be available for the purpose of verifying the pricing of any goods offered for sale by any person carrying on a manufacturing, wholesale or retail business; and if such evidence as may be required be not forthwith furnished although

available, or on being furnished be found to be in any respect false or if the person authorised as aforesaid be obstructed or hindered in the performance of his duties, the person so offending as well as the owner, manager or other person in charge of the business shall be guilty of an offence under these Regulations.

(2) If any persons makes default in complying with the provisions of this regulation with regards to the production or furnishing of any articles, invoices, books or other documents or information he shall be liable on summary conviction to a fine not exceeding one thousand dollars and if after being convicted he continues to make the like default, he shall be guilty of a further offence and shall be liable on summary conviction to a fine not exceeding two hundred dollars for each day on which the default continues after the first mentioned conviction, or to imprisonment for a term not exceeding six months or to both such fine and such imprisonment.

19. (1) If with respect to any premises, the Controller of Supplies has reasonable grounds for suspecting that an offence against these Regulations has been or is being committed, and that evidence of the commission of the offence is to be found at such premises, and is satisfied -

(a) that it is essential in the public interest that the premises should be searched for the purpose of obtaining such evidence; and

(b) that the evidence is not likely to be found at the premises unless they are forthwith searched, the Controller of Supplies may, by written order under his hand, authorise any person or persons named in the order, or any police officer to enter the premises, if necessary by force and to search the premises and to seize any articles or goods found in the premises which the person or persons or police officer, as aforesaid has or have reasonable

grounds for believing to be evidence of commission of such offence.

(2) The Controller of Supplies or a person authorised by the Controller of Supplies, the Senior Price Control Officer, a price control officer or a police officer, may at any time during the business hours of any premises in which price-controlled goods are exposed or offered for sale, either by retail or wholesale, enter any part of the premises in which such goods are so offered for sale or exposed and inspect such goods, and any price list, or mark indicating price relating thereto.

20. The Controller of Supplies may order any person to make a statutory declaration within such times as may be signified in the order giving full and accurate particulars of all matters relating to articles or goods mentioned in the order belonging to him or in his possession, power or control or which at any time belonging to him or were in his possession, power or control and the place of storage of such articles or goods as well as the disposal thereof in so far as they are no longer in his possession, power or control.

21. Whenever the Minister declares by publication in the Gazette that a particular industry or trade or section of industry or trade or a particular commodity or type of commodity whether manufactured or produced in this country or abroad is being considered for inclusion in these Regulations, then such powers of search and inspection as well as powers to demand information or statutory declarations as are by these Regulations granted to persons in respect of goods encompassed by these Regulations shall to the like extent apply to all goods as are encompassed in the Minister’s declaration.

22. Invoices in respect of all imported price-controlled goods or articles received by traders shall be submitted to the Controller of Supplies within seven days after receipt of same accompanied by a copy of the customs entry and by two copies of a completed cost sheet as described in the Third Schedule to these Regulations, showing the cost and the proposed selling price.

Supplies Control

23. No vendor shall in any manner intimidate or victimise or attempt to intimidate or victimise any person who has given or is about to give evidence against such vendor in proceedings under these Regulations, or who has been in any way concerned in the prosecution or intended prosecution of any vendor under these Regulations.

24. The Controller of Supplies may with the prior approval of the Minister reward any person who may have supplied such information or given such assistance as has led to the conviction of an offender for an offence against these Regulations.

25. (1) If there shall be any contravention of the provisions of these Regulations, or of any licence issued under these Regulations, every person who is a party to such contravention and also the owner of any article or goods with respect to which the contravention takes place, unless he proves that the contravention took place without his knowledge, instigation, consent or approval, shall be guilty of an offence under these Regulations.

(2) Where a person convicted of a contravention of any of the provisions of these Regulations is a body corporate, every person who, at the time of the contravention, was a director, or officer of the body corporate shall be deemed to be guilty of that contravention, unless he proves that the contravention was committed without his consent or connivance and that he exercised all such diligence to prevent the contravention as he ought to have exercised having regard to the nature of his functions as a director or officer of that body and to all the circumstances.

26. Notwithstanding any enactment prescribing a time within which proceedings may be brought before a court of summary jurisdiction, proceedings for an offence under this section may be brought:-

(a) within a period of six months from the date of the commission of the alleged offence; or

(b) within a period which exceeds neither three months from the date on which it came to the knowledge of the Controller of Supplies that the offence had been committed nor one year from the date of the commission of the offence whichever is longer.

27. An information and complaint in respect of any contravention of any of these Regulations may be laid by the Controller of Supplies, a price control officer or a police officer.

28. (1) If any person contravenes or fails to comply with any of these Regulations, or any direction or requirement imposed under any of these Regulations, or if any person obstructs or hinders or causes to be obstructed or hindered any person acting in pursuance of the power conferred by any of these Regulations, then, in all such cases for which a specific penalty is not provided in any other of these Regulations, such person shall be guilty of an offence against these Regulations and shall on summary conviction be liable to a fine not exceeding one thousand dollars or to imprisonment for a term not exceeding six months, or to both such fine and imprisonment.

(2) If a person is convicted on three or more occasions of the offences of selling any price-controlled goods above the maximum permitted prices under these or any other Regulations made under the Supplies Control Act, the Magistrate may order that such person be no longer allowed to practise his trade or to hold a licence to carry on his business for any period not exceeding one year from the date of the order.

(3) Where a person has been convicted of any offence under these Regulations, any goods or articles in relation to which the offence was committed shall be forfeited.

29. Any person who is aggrieved by the decision of the Controller of Supplies may appeal to the Minister.
