Migration Regulations 2 (Amendment)
 
 
I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Migration Act 1958.

1.    Commencement
 
1.1    Regulation 9.3 is taken to have commenced on 10 December 1990.
 
1.2    Regulation 14 commences on 1 February 1991.
 
1.3    Regulation 20 is taken to have commenced on 31 May 1990.2.    Amendment
 
2.1    The Migration Regulations are amended as set out in these Regulations.
 
 
 
3.    Regulation 19 (Grant of return visa in emergency (Australian permanent resident) before 10 December 1990)
 
3.1    Omit the regulation.
 
 
 
4.    Regulation 35AA (Grant of entry permit—illegal entrants)
 
4.1    Sub-subparagraph 35AA (1) (c) (iv) (E):
Omit the sub-subparagraph, substitute:
 
                                    “(E)   that the person intends to comply with any condition subject to which the entry permit is granted; or”.
 
4.2    Add at the end:
 
             “(3)  If the applicant for an entry permit is an illegal entrant who does not satisfy a criterion applicable to the applicant that is specified:
               (a)  in subregulation 42 (1A); or
               (b)  if the entry permit is a December 1989 (temporary) entry permit or a December 1989 (permanent) entry permit, in subregulation 42 (1B);
the Minister must refuse the application.”.
 
 
 
 
 
5.    Regulation 36 (Restrictions on re-entry)
 
5.1    Paragraphs 36 (1) (a) and (b):
Add at the end “or”.
 
 
5.2    Paragraph 36 (1) (c):
Omit:
                     “a person deported from Australia on grounds other than the commission of a crime or security grounds;
                     unless:”,
substitute:
                     “a person deported from Australia, otherwise than on grounds of the commission of a crime or on security grounds, unless:”.
 
5.3   Paragraphs 36 (1) (c) and (d):
Add at the end “or”.
 
 
 
6.    Regulation 37 (“Prescribed vessel” and “prescribed crew-member”—subsection 4 (1) (definition of “exempt non-citizen”))
 
6.1    Omit the regulation, substitute:
 
“Prescribed vessel” and “prescribed crew-member”—subsection 4 (1) (definition of “exempt non-citizen”)
            “37.  For the purposes of paragraph (d) of the definition of ‘exempt non-citizen’ in subsection 4 (1) of the Act:
               (a)  every vessel that calls at proclaimed ports is prescribed, unless it is a vessel that:
                           (i)  is employed as a cargo vessel; or
                          (ii)  is engaged in the carriage of passengers for reward; or
                         (iii)  is a vessel owned or operated by a foreign government  and employed solely or principally for purposes of scientific research; and
               (b)  every member of the crew of a vessel who does not have genuine employment:
                           (i)  in the operation of the vessel; or
                          (ii)  in the case of a vessel of a kind referred to in paragraph (1) (c), in scientific research conducted on or from the vessel;
                     is prescribed as a crew member.”.
 
 
 
 
7.    Regulation 37A (Endorsement of visa or entry permit in relation to section 20 notice—code or abbreviation)
 
7.1   Omit the regulation, substitute:
 
Endorsement of visa or entry permit in relation to section 20 notice—code or abbreviation
 
    “37A.   (1)  For the purposes of subsection 20 (4) of the Act, a visa endorsed in accordance with that subsection may be endorsed to represent a provision of section 20 of the Act that is specified in column 2 of an item of Schedule 7 by the code (if any) that is specified in Column 3 of the item.
 
             “(2)  For the purposes of subsection 20 (5) of the Act, an entry permit endorsed in accordance with that subsection may be endorsed to represent a provision of section 20 of the Act that is specified in column 2 of an item of Schedule 7 by the code (if any) that is specified in Column 4 of the item.”.
 
 
8.    Regulation 40 (Prescribed change in circumstances—paragraphs 36 (1) (a) and 37 (2) (a) of the Act)
 
8.1    Subregulation (1):
Add at the end:
 
            “(m)  the applicant satisfies the criteria for the grant of a Lebanese (temporary) entry permit;
               (n)  the applicant satisfies the criteria for the grant of a Sri Lankan (temporary) entry permit.”.
 
 
9.   Regulation 42 (Prescribed criteria—entry permits)
 
9.1   Subregulation 42 (1):
Omit “of a class specified”, substitute “referred to”.
 
9.2   Subregulation 42 (1):
Omit “that class of entry permits.”, substitute “that entry permit.”.
 
 
 
9.3    Subregulation 42 (1A):
Omit the subregulation, substitute:
 
           “(1A)  Where an illegal entrant applies for an entry permit, other than an entry permit of a kind to which subregulation (1B), (2) or (6) applies, the following criteria are prescribed:
               (a)  in the case of an applicant for the entry permit who:
                           (i)  has been an illegal entrant for less than 12 months; and
                          (ii)  has been arrested under section 92 or 93 of the Act;
                     the applicant has applied for the entry permit:
                         (iii)  not later than 2 working days after being so arrested; or
                         (iv)  if, not later than 2 working days after being so arrested, the applicant asks the Minister in writing to be allowed to apply for the entry permit within 7 working days after being so arrested—not later than the expiry of those 7 working days; or
               (b)  in the case of an applicant for the entry permit who:
                           (i)  has been arrested under section 92 or 93 of the Act on or before 10 December 1990; and
                          (ii)  satisfies the criteria specified in subparagraph 127 (a) (vi); and
                         (iii)  is an applicant for an extended eligibility (family) entry permit;
                     the applicant has applied for the entry permit:
                         (iv)  not later than 12 December 1990; or
                          (v)  if, not later than 12 December 1990, the applicant asks the Minister, in writing to be allowed to apply for the entry permit within 5 working days after being so arrested—not later than the expiry of those 5 working days; or
               (c)  in the case of an applicant for the entry permit who:
                           (i)  has been arrested under section 92 or 93 of the Act after 10 December 1990; and
                          (ii)  satisfies the criteria specified in subparagraph 127 (a) (vi); and
                         (iii)  is an applicant for an extended eligibilty (family) entry permit;
                     the applicant has applied for the entry permit:
                         (iv)  not later than 2 working days after being so arrested; or
 
                          (v)  if, not later than 2 working days after being so arrested, the applicant asks the Minister in writing to be allowed to apply for the entry permit within 7 working days after being so arrested—not later than the expiry of those 7 working days; or
              (d)  in the case of an applicant who has not been arrested under section 92 or 93 of the Act, the applicant:
                           (i)  is a prescribed applicant within the meaning of subregulation (1C); or
                          (ii)  has applied for the entry permit not later than 12 months after becoming an illegal entrant; or”.
 
9.4   After subregulation 42 (1A) insert:
 
           “(1B)  The following criteria are prescribed in relation to December 1989 (temporary) entry permits and December 1989 (permanent) entry permits:
               (a)  in the case of an applicant who has been arrested under section 92 or 93 of the Act on or before 10 December 1990—the applicant applied for the entry permit:
                           (i)  not later than 12 December 1990; or
                          (ii)  if, not later than 12 December 1990, the person asked the Minister in writing to be allowed to apply within a further 5 working days after 12 December 1990—not later than the expiry of those 5 working days; or
               (b)  in the case of an applicant who has been arrested under section 92 or 93 of the Act after 10 December 1990—the applicant applied for the entry permit:
                           (i)  not later than 2 working days after being so arrested; or
                          (ii)  if, not later than 2 working days after being so arrested, the person asks the Minister in writing to be allowed to apply for the entry permit within 7 working days after being so arrested—not later than the expiry of those 7 working days; or
               (c)  in the case of an applicant who was a prohibited non-citizen on or before 18 December 1989—the applicant has not at any time been arrested under section 92 or 93 of the Act.”.
 
 
 
 
 
9.5   Sub-subparagraph 42 (1C) (c) (i) (B):
Omit the sub-subparagraph, substitute:
 
                                    “(B)   the holder of a return visa, Class A, B, C, D or E, granted before 10 December 1990 in circumstances declared by subregulation (1E) to be special circumstances; or”.
 
9.6   After subregulation (1D), insert:
 
           “(1E)  For the purposes of sub-subparagraph (1C) (c) (i) (B), a return visa was granted in special circumstances if, when applying for the visa, the holder:
               (a)  claimed to have been an Australian permanent resident immediately before going overseas; and
               (b)  was unable to provide satisfactory evidence to substantiate that claim; and
               (c)  satisfied the Minister that he or she had urgent and compelling reasons for travelling to Australia before the claim could be substantiated.”.
 
9.7    Subregulation 42 (2):
Omit “in Schedule 3, in Schedule 3”, substitute “in Schedule 3”.
 
 
10.    Regulation 50 (Distinguished talent visa)
 
10.1    Sub-subparagraph 50 (e) (ii) (A):
Omit “Security and Intelligence”, substitute “Security Intelligence”.
 
 
11.    Regulation 71 (Medical practitioner visa)
 
11.1    Subparagraph 71 (c) (iii):
Omit the subparagraph, substitute:
 
                        “(iii)  the position is to be adequately paid, having regard to Australian levels of remuneration and conditions; and”.
 
 
 
 
12.   Regulation 119C (Resident return E entry permit)

13.    Regulation 119G (Sri Lankan (temporary) entry permit)

               (b)  in any other case, the applicant:
                           (i)  is outside Australia at the time of making the application; and

                                     (A)   the spouse; or

                                 of a person who holds a PRC (temporary) entry permit or visa; and
                         (iii)  satisfies the criteria specified in item 9 of Schedule 1.”.
 
15.    Regulation 120 (Criteria in relation to certain temporary entry permits to be granted to holders of certain visitor visas or temporary entry permits, or visitor entry permits)
 
15.1    Paragraph 120 (g):
Omit “termporary”, substitute “temporary”.

             “(2)  In this regulation:
‘the Professional-Equivalent Occupation List’ and ‘the Technical-Equivalent Occupation List’ mean the lists of occupations, by those respective names, that the Minister declares by notice published in the Gazette to be lists of Professional-Equivalent Occupations or Technical-Equivalent Occupations;
‘usual occupation’ means an occupation that the applicant has engaged in for gain or reward for a continuous period of at least 6 months during the period of 2 years immediately preceding the relevant application for a visa or entry permit.”.
 
 
20.    Regulation 173A (Reconsideration of decision to refuse to grant visa or entry permit)
 
20.1   Paragraph 173A (3) (b):
Omit “applicant”, substitute “applicant:”.
 
20.2    Subparagraphs 173A (4) (a) (i) and (b) (i):
Omit “making of the decision;”, substitute “applicant was notified of the decision in accordance with these Regulations;”.

        “190A.  (1)  Subject to subregulation (2), the fee payable for the grant of a December 1989 (temporary) entry permit is $360.
 
             “(2)  No fee is payable for the grant of a December 1989 (temporary) entry permit if the application for the entry permit is preceded by the withdrawal by the applicant of any application for an entry permit made by the applicant before 15 October 1990.”.
 
 
23.    Regulation 191 (Fee on application for a visa to enable holder to re-enter Australia)
