I, NICK MINCHIN, Minister for Finance and Administration, make the following Declaration under paragraph 6 (1) (j) of the Superannuation Act 1990. Dated 18 July 2005 NICK MINCHIN Minister for Finance and Administration
1              Name of Declaration                 This Declaration is the Superannuation (PSS) Membership Inclusion Amendment Declaration 2005 (No. 2). 2              Commencement                 This Declaration is taken to have commenced on 31 December 2004. 3              Amendment of Superannuation (PSS) Membership Inclusion Declaration 1995                 Schedule 1 amends the Superannuation (PSS) Membership Inclusion Declaration 1995.
Schedule 1        Amendments (section 3)    [1]           After subsection 3 (16) insert        (17)   Section 6 of the 1990 Act applies to a person referred to in item 24 in Schedule 1 only while a controlling interest in Rhodium Asset Solutions Limited is held by all or any of the following:                 (a)    the Australian Capital Territory (or its nominees);                (b)    an authority or body, whether a body corporate or not, established for a public purpose by or under a law of the Australian Capital Territory;                 (c)    a company, or other body corporate, in which the Australian Capital Territory (or its nominees), or an authority or body referred to in paragraph (b), has a controlling interest. [2]           Schedule 1, after item 23 insert       24       A person who:                 (a)    becomes an employee of Rhodium Asset Solutions Limited on 31 December 2004; and                (b)    immediately before becoming so employed:                           (i)    was an employee of Totalcare Industries Limited; and                          (ii)    was a member of the scheme provided for by the 1990 Act; and                 (c)    continues to be an employee of Rhodium Asset Solutions Limited; and                (d)    is not, in relation to that employment, a member of an alternative superannuation scheme.
