I, STEPHEN DELLAR, Assistant Secretary, Residential Program Management Branch, Ageing and Aged Care Division, Department of Health and Ageing, make this Determination under subsection 44-29 (2) of the Aged Care Act 1997.       1              Name of Determination                 This Determination is the Aged Care (Residential Care Subsidy) (Viability Supplement — Eligible Residential Care Services) Determination 2005 (No. 1). 2              Commencement                 This Determination is taken to have commenced on 1 January 2001. 3              Revocation of previous determinations                 All previous determinations made under subsection 44-29 (2) of the Aged Care Act 1997 before 1 January 2001 are revoked. 4              Definitions                 In this Determination: 1997 scheme service means a residential care service:                 (a)    to which section 21.34A of the Principles applies; and                (b)    that scores at least 60 points under the scoring system set out in the table in subsection 21.34A (3) of the Principles. 2001 scheme service means a residential care service:                 (a)    that is not a 1997 scheme service; and                (b)    that scores at least 40 points under the scoring system set out in the table in subsection 21.34 (1) of the Principles. Principles means the Residential Care Subsidy Principles 1997, as in force on 1 January 2001. 5              Determination of residential care services          (1)   This Determination is made in accordance with Part 14 of the Principles.          (2)   This Determination is made in respect of each residential care service that is a 1997 scheme service or a 2001 scheme service.
