I, KEVIN JAMES ANDREWS, Minister for Employment and Workplace Relations, make this Notice under subsection 5(6) of the Safety, Rehabilitation and Compensation Act 1988. Dated 5 January 2005 Kevin Andrews Minister for Employment and Workplace Relations
1              Name of Notice                 This Notice is the Safety, Rehabilitation and Compensation (Definition of Employee) Notice 2005. 2              Commencement                 This Notice commences on 5 January 2005. 3              Declaration                 For subsection 5(6) of the Safety, Rehabilitation and Compensation Act 1988 (the Act), I declare that the class of persons referred to in Schedule 1, being persons who engage in activities or perform acts at the request or direction of the Commonwealth or a Commonwealth authority or licensed corporation, shall be taken to be employed by the Commonwealth, the Commonwealth authority or a licensed corporation as the case may be, and the employment of such persons shall, for those purposes, be taken to be constituted by the performance by such persons of the acts or activities referred to in Schedule 1.

Persons who, for the benefit of the Commonwealth or a Commonwealth authority or a licensed corporation, at the direct or indirect request of, or at the direction of, the Commonwealth or a Commonwealth authority or licensed corporation, participate in relief missions in relation to areas affected by the earthquake and tsunami in the Indian Ocean on 26 December 2004.  
Acts performed in Australia and overseas, pursuant to arrangements made with the Commonwealth, a Commonwealth authority or a licensed corporation, for which those persons in Schedule 1 are not covered by an alternative workers’ compensation scheme to the scheme established by the Safety, Rehabilitation and Compensation Act 1988.
