Determination 2006/20:
Remuneration and Allowances for Holders of Public Office and Members of Parliament
 
(i)        Pursuant to subsections 7(1), 7(3), and 7(4) of the Remuneration Tribunal Act 1973, the Remuneration Tribunal has inquired into the remuneration and allowances to be paid to holders of public office and Members of Parliament, and other matters significantly related thereto, and determines as set out below.
 
(ii)        This Determination takes effect on and from the day following the day it is registered in the Federal Register of Legislative Instruments unless otherwise specified.
 
PART 1 – PART-TIME OFFICES
 
1.1             In this part, Determination Number 12 of 2006 is referred to as the Principal Determination.
 
1.2             Table A1A of Schedule A of the Principal Determination is amended by including the following entry:

1.3                 Clause 1.2 has effect on and from 15 September 2006.
 
1.4                 Table A1A of Schedule A of the Principal Determination is amended by deleting the entry for the “Australian Research Council” including associated entries in Columns 2-5.
 
1.5                 Table A1A of Schedule A of the Principal Determination is amended by deleting the entry for the “Commissioner for Complaints of the Aged Care Complaints Resolution Scheme” including associated entries in Columns 2-5.
 
1.6                 Clause 1.5 has effect on and from 1 November 2006.
 
PART 2 – FULL-TIME OFFICES
 
2.1             In this part, Determination Number 13 of 2006 is referred to as the Principal Determination.

2.2             Part 2 of the Principal Determination is amended by inserting the following words at the end of Clause 2.2.3 (Migration Review Tribunal and Refugee Review Tribunal, Principal Member): “Mr Karas will be entitled to Tier 1 travel while he occupies this office.”
2.3             Clause 2.2 has effect on and from 17 October 2006.
2.4             Part 3 of the Principal Determination is amended by inserting the following clause after clause 3.1.3:
”3.1.4 Official residence: Where residing in an official residence is a requirement of an office, total remuneration does not include the value of accommodation in the official residence, or the running costs of the premises.”
 
2.5             The insertion of the ‘Official Residence’ clause will cause the renumbering in the Principal Determination of current clause 3.1.4 “Professional Services Review”.  This will henceforth be clause 3.1.5, with no other change.
          
2.6             Part 4 of the Principal Determination is amended by inserting the following clause after clause 4.1:
”4.1.1 Administrator Christmas and Cocos (Keeling) Islands. For the period of his appointment Mr Neil Lucas and any immediate family members resident with him on Christmas Island shall be entitled to two return economy class fares per annum between his home and work base.”

2.7             Part 5 of the Principal Determination is amended by inserting the following clause, after clause 5.1:
”5.1.1 Administrator Christmas and Cocos (Keeling) Islands. For the period of his appointment, Mr Neil Lucas is entitled to seven days recreation leave per annum, additional to any entitlement in Clause 5.1.”
 
2.8             Table A1A of Schedule A of the Principal Determination is amended by inserting the following entry, immediately after the entry for ‘Principal Member, Migration Review Tribunal’

2.9             Clause 2.5 takes effect on and from 1 November 2006.
 
PART 3 – MEMBERS OF PARLIAMENT
 
3.1             In this part, Determination Number 18 of 2006 is referred to as the Principal Determination.
 
3.2             The Principal Determination is amended by deleting the current clause 9.13 and replacing it with the following clause:
 
“9.13  For the purpose of clauses 9.1 – 9.12, the entitlements available in relation to the ‘spouse’ of a senator or member may be available instead to a nominee, at the discretion of the Special Minister of State.”
 
3.3      Clause 3.2 has effect on and from 1 November 2006.
