I, JUSTINE ELLIOTT, Minister for Ageing, make this Determination under subsection 5 (3) of the Hearing Services Administration Act 1997.

1              Name of Determination
                This Determination is the Hearing Services (Eligible Persons) Amendment Determination 2008 (No. 1).
2              Commencement
                This Determination commences on 1 January 2009.
3              Amendment of Hearing Services (Eligible Persons) Determination 1997
                Schedule 1 amends the Hearing Services (Eligible Persons) Determination 1997.

(section 3)
  
[1]           Section 3 (definition of de facto spouse)
Repeal the definition of de facto spouse, substitute:
 
de facto partner of a person means:
                     (a)  another person (whether of the same sex or a different sex) with whom the person has a relationship that is registered under a law of a State or Territory prescribed for the purposes of section 22B of the Acts Interpretation Act 1901 as a kind of relationship prescribed for the purposes of that section; or
                     (b)  another person (whether of the same sex or a different sex) who is living with the person on a genuine domestic basis although not legally married to the person.
 
[2]           Section 3 (definition of dependent)
 
Omit “de facto spouse” wherever appearing under the definition of “dependent”, substitute “de facto partner”.
