I, KATE ELLIS, Minister for Early Childhood Education, Childcare and Youth, make this determination under subsection 162 (3) of the A New Tax System (Family Assistance) (Administration) Act 1999.

1              Name of determination
                This determination is the A New Tax System (Family Assistance) (Administration) (Release of Protected Information) (DEEWR) Determination 2009 (No. 1).
2              Commencement
                This determination commences on the day after the end of the period in which the determination could be disallowed in either House of Parliament.
Note   Section 42 of the Legislative Instruments Act 2003 sets out the period in which a legislative instrument may be disallowed.
3              Definitions
                In this determination:
Act means the A New Tax System (Family Assistance) (Administration) Act 1999.
Support for the Child Care System Program means Program 1.1 in the DEEWR 2009-10 Portfolio Budget Statements for which the administered item is known as the Child Care Services Support Program.
4              Purpose for which protected information may be obtained, recorded, disclosed or otherwise used
                For subsection 162 (3) of the Act, the protected information mentioned in section 5 may be obtained, recorded, disclosed or otherwise used for the purpose of informing members of the public about vacant child care places in approved child care services.
Example
The protected information may be disclosed to a member of the public by the Department making the information available on a website.
5              Information that may be disclosed etc.
                The following information relating to the Support for the Child Care System Program may be obtained, recorded, disclosed or otherwise used for the purpose mentioned in section 4:
                (a)    the name, address and contact details of an approved child care service;
               (b)    whether an approved child care service has vacant child care places;
                (c)    the number and type of vacant child care places at an approved child care service.
Note   Information about vacant child care places may be published on an aggregate basis, for example, the number of places in a given location.
