Macquarie Island Toothfish Fishery Management Plan Temporary Order 2009 (No. 1)

I, PAUL MURPHY, Acting Chief Executive Officer of the Australian Fisheries Management Authority make this Order under subsection 43(2) of the Fisheries Management Act 1991, being satisfied that:
(a)       it is necessary to take action under Section 43 of the Fisheries Management Act 1991; and
(b)       the action is consistent with AFMA’s objectives; and
(c)        no other action is appropriate.

1          Name of Order
This Order is the Macquarie Island Toothfish Fishery Management Plan Temporary Order 2009 (No. 1).
2          Commencement
            This Order commences on 1 July 2009.
3          Order applies to the Macquarie Island Toothfish Fishery Management Plan 2006 (Act s 43)
            For section 43 of the Fisheries Management Act 1991, the Macquarie Island Toothfish Fishery Management Plan 2006 is to be applied as if amended by the item in Schedule 1.
4          Cessation of Order
This Order ceases to have effect on the earlier of the following:
(a)               the commencement of the Macquarie Island Toothfish Fishery Management Plan Amendment 2009 (No. 1); or
(b)               the day 6 months after the commencement of this Order.

substitute
fishing year means the following:
(a)               the period beginning on 1 July 2009 and ending at the end of 14 April 2010;
(b)               each subsequent year beginning on 15 April.
