(a)   I, James Findlay, delegate of the Australian Fisheries Management Authority, make this order under subsection 43(2) of the Fisheries Management Act 1991.

1              Name of Order
                This Order is the Bass Strait Central Zone Scallop Fishery Management Plan Temporary Order 2010 (No. 2).
 
2              Commencement and period of application
                This Order commences on the day it is registered and applies for a period of 6 months.
 
3              Order applies to:
a.      the Bass Strait Central Zone Scallop Fishery (Closures) Direction No. 2 2010, in force under s23(1) of the Bass Strait Central Zone Scallop Fishery Management Plan 2002; and
b.      associated conditions on statutory fishing rights in force under that Management Plan.
 
4.             In Schedule 1 to the said Direction, and despite clause 7.1, ‘Area 1 – Southern Box’, paragraph (a) is suspended and replaced with the following:
                “(a) commencing at the point of intersection of the parallel of latitude 39°12.000’ South and the meridian of longitude 148°20.000’ East; and”
                Note: As a consequence, the area of waters described in Schedule 2, ‘Area 2 – Northern Box’, forms part of Area 1.
 
5.                      Despite condition 3., headed ‘Restrictions’, on statutory fishing rights in force under the said Management Plan - which condition was determined on 12 July 2010 and prohibits navigation in certain areas of waters - a concession holder, or a person acting on behalf of the holder, is not prohibited from entering or otherwise navigating in the area of waters described in paragraph (b) of the condition, and referred to as ‘Area 2’.
