Amendment Statement of Principles
concerning
 
NEOPLASM OF THE PITUITARY GLAND
No. 122 of 2011
 
for the purposes of the
 
Veterans’ Entitlements Act 1986
and
Military Rehabilitation and Compensation Act 2004
 
1.                     This Instrument may be cited as Statement of Principles concerning neoplasm of the pituitary gland No. 122 of 2011.
 
2.                     The Repatriation Medical Authority amends, under subsection 196B(8) of the Veterans’ Entitlements Act 1986, Statement of Principles concerning neoplasm of the pituitary gland Instrument No. 43 of 2004 by:
 
(A)             Deleting existing factors "(a)" and "(b)" from clause 5;
 
(B)              Inserting a new factor "(a)" in clause 5 as follows:
 
"(a)       for ACTH secreting pituitary adenomas only, undergoing bilateral adrenalectomy before the clinical worsening of neoplasm of the pituitary gland; or";
 
(C)              Re-numbering the existing factor "(c)" in clause 5 as "(b)"; and
 
(D)             Replacing the existing clause 6 with the following:
 
"6.       Paragraphs 5(a) and 5(b) apply only to material contribution to, or aggravation of, neoplasm of the pituitary gland where the person’s neoplasm of the pituitary gland was suffered or contracted before or during (but not arising out of) the person’s relevant service.".
 
3.                     The amendment made by this instrument applies to all matters to which Instrument No. 43 of 2004, section 120B of the Veterans’ Entitlements Act 1986 and section 339 of the Military Rehabilitation and Compensation Act 2004 apply.
 
4.                     The amendment made by this instrument takes effect from 2 November 2011.
