1 Name of Regulations
These Regulations are the Migration Legislation Amendment Regulations 2011 (No. 1).
2 Commencement
These Regulations commence on 1 July 2011.
3 Amendment of Migration Regulations 1994 — Schedule 1
(1) Schedule 1 amends the Migration Regulations 1994.
(2) The amendment made by Schedule 1 applies in relation to an application for a visa made on or after 1 July 2011.
4 Amendment of Migration Regulations 1994 — Schedule 2
(1) Schedule 2 amends the Migration Regulations 1994.
(2) The amendments made by Schedule 2 apply in relation to an application for a visa made on or after 1 July 2011.
5 Amendment of Migration Regulations 1994 — Schedule 3
(1) Schedule 3 amends the Migration Regulations 1994.
(2) The amendments made by items [2] to [7] of Schedule 3 apply in relation to an application for a visa made on or after 1 July 2011.
6 Amendment of Migration Regulations 1994 — Schedule 4
(1) Schedule 4 amends the Migration Regulations 1994.
(2) The amendments made by Schedule 4 apply in relation to an application for a visa:
(a) made, but not finally determined (within the meaning of subsection 5 (9) of the Migration Act 1958), before 1 July 2011; or
(b) made on or after 1 July 2011.
7 Amendment of Migration Regulations 1994 — Schedule 5
(1) Schedule 5 amends the Migration Regulations 1994.
(2) The amendments made by items [1] and [6] to [8] of Schedule 5 apply in relation to an application for a visa made on or after 1 July 2011.
(3) The amendments made by items [2] to [5] of Schedule 5 apply in relation to all bridging visas that are held at any time on or after 1 July 2011, regardless of whether the bridging visas were granted before, on or after 1 July 2011.
8 Amendment of Migration Regulations 1994 — Schedule 6
Schedule 6 amends the Migration Regulations 1994.
9 Amendment of Migration Regulations 1994 — Schedule 7
(1) Schedule 7 amends the Migration Regulations 1994.
(2) The amendments made by Schedule 7 apply in relation to an application for a visa:
(a) made, but not finally determined (within the meaning of subsection 5 (9) of the Migration Act 1958), before 1 July 2011; or
(b) made on or after 1 July 2011.
10 Amendment of Migration Regulations 1994 — Schedule 8
(1) Schedule 8 amends the Migration Regulations 1994.
(2) The amendments made by Schedule 8 apply to a matter for which an obligation to pay a fee or charge is incurred on or after 1 July 2011.
11 Amendment of Migration Regulations 1994 — Schedule 9
(1) Schedule 9 amends the Migration Regulations 1994.
(2) The amendments made by Schedule 9 apply in relation to an application for a visa made on or after 1 July 2011.
12 Amendment of Migration Amendment Regulations 2009 (No. 12) — Schedule 10
Schedule 10 amends the Migration Amendment Regulations 2009 (No. 12).
13 Amendment of Australian Citizenship Regulations 2007 — Schedule 11
(1) Schedule 11 amends the Australian Citizenship Regulations 2007.
(2) The amendments made by Schedule 11 apply in relation to an application made under section 21 of the Australian Citizenship Act 2007 on or after 1 July 2011.
14 Amendment of Australian Citizenship Regulations 2007 — Schedule 12
(1) Schedule 12 amends the Australian Citizenship Regulations 2007.
(2) The amendment made by Schedule 12 applies in relation to an application for evidence of Australian citizenship made under section 37 of the Australian Citizenship Act 2007 on or after 1 July 2011.
15 Amendment of Australian Citizenship Regulations 2007 — Schedule 13
(1) Schedule 13 amends the Australian Citizenship Regulations 2007.
(2) The amendment made by Schedule 13 applies in relation to an application if:
(a) the application is made under a provision of the Australian Citizenship Act 2007; and
(b) the application is made on or after 1 July 2011.
Schedule 1 Amendment of Migration Regulations 1994 relating to personal identifiers

(3) For paragraph 40 (3) (a) and subsection 40 (5) of the Act, a circumstance is that:
(a) a person:
(i) is an applicant for a class of visa; and
(ii) is not in Australia at the time of the application; and
(b) the personal identifiers mentioned in subregulation (6) are provided at a place specified by the Minister in an instrument in writing for this paragraph.
(4) For paragraph 40 (3C) (a) of the Act, fingerprints of a person (including those taken using paper and ink or digital livescanning technologies) are prescribed.
(5) For subsection 40 (5) of the Act, the following types of personal identifier are prescribed for the circumstance mentioned in subregulation (2):
(a) a photograph or other image of the applicant’s face and shoulders;
(b) the applicant’s signature.
(6) For subsection 40 (5) of the Act, the following types of personal identifier are prescribed for the circumstance mentioned in subregulation (3):
(a) fingerprints of the applicant (including those taken using paper and ink or digital livescanning technologies);
(b) a photograph or other image of the applicant’s face and shoulders.
Schedule 2 Amendments of Migration Regulations 1994 relating to balance of family test
(regulation 4)

(2) For this regulation:
(a) a child of the parent is an eligible child if the child is:
(i) an Australian citizen; or
(ii) an Australian permanent resident usually resident in Australia; or
(iii) an eligible New Zealand citizen usually resident in Australia; and
(b) any other child of the parent is an ineligible child.
(2A) An ineligible child is taken to be resident overseas.
(2B) The overseas country in which an ineligible child is taken to reside is:
(a) the overseas country in which the child is usually resident; or
(b) the last overseas country in which the child was usually resident; or
(c) if the child no longer has a right of return to the country mentioned in paragraph (a) or (b) — the child’s country of citizenship.
(2C) A parent satisfies the balance of family test if the number of eligible children is greater than or equal to the number of ineligible children.
(2D) However, if the greatest number of children who are:
(a) ineligible children; and
(b) usually resident in a particular overseas country;
is less than the number of eligible children, then the parent satisfies the balance of family test.

Schedule 5 Amendments of Migration Regulations 1994 relating to Bridging E (Class WE) visas

2.24 Eligible non-citizen in immigration detention
(1) For paragraph 75 (1) (a) of the Act (which deals with the class of bridging visa that may be granted to a non-citizen in immigration detention), the prescribed classes of bridging visa are:
(a) Bridging E (Class WE) visa; and
(b) Bridging F (Class WF) visa.
(2) For a Bridging E (Class WE) visa:
(a) if the applicant is an eligible non-citizen of the kind mentioned in subregulation 2.20 (7), (8), (9), (10) or (11), the subclass to be granted is a Subclass 051 Bridging (Protection Visa Applicant) visa; and
(b) if paragraph (a) does not apply, the subclass to be granted is a Subclass 050 Bridging (General) visa.
(3) For paragraph 75 (1) (b) of the Act (which deals with the time in which the Minister must make a decision on a bridging visa application), if the application is for a Bridging E (Class WE) visa, each item in the table sets out a period for the circumstances mentioned in the item.

(iii) must provide, at the same time and place as making the application, 2 statutory declarations each of which:
(A) is made by an Australian citizen, Australian permanent resident or eligible New Zealand citizen who is not the partner; and
(B) declares that the applicant and the partner are in a married relationship or de facto relationship; and
(C) was declared no more than 6 weeks before the day on which the application for the Partner (Residence) (Class BS) visa was made.
