Exemption — recency flying at night by holders of night V.F.R. agricultural ratings
1          Duration
                 This instrument:
(a)   commences on 1 March 2011; and
(b)   stops having effect at the end of February 2013.
2          Application
                 This instrument applies to the holders of night V.F.R. agricultural ratings (agricultural pilots) who do not meet the requirements of paragraph 5.1 of Appendix II of Civil Aviation Order 40.2.2 (the Order).
3          Exemption
                 Agricultural pilots are exempt from compliance with the requirements of subregulation 5.14 (1) of CAR 1988 in relation to recent experience requirements mentioned in subparagraph 5.1 (a) of Appendix II of the Order.
4          Conditions
                 The exemption is subject to the conditions mentioned in Schedule 1.
Schedule 1          Conditions
        1     An agricultural pilot may exercise the authority given by the rating if he or she:
(a)   has obtained a minimum of 10 hours’ flying experience at night in agricultural operations in the 12 months preceding the flight; or
(b)   has practised the necessary manoeuvres by night in an unladen agricultural aircraft before resuming night spraying operations, including at least 1 hour of night circuits and simulated spray runs along the runway lights or flare path; and
(c)   has carried out an aerial application operation that started 20 minutes or more before, and continued past, last light.
        2     An agricultural pilot must continue to meet the requirements of subparagraph 5.1 (b) of Appendix II of the Order if continuity of night spraying is broken by more than 35 days.
