SPECIFICATION OF CLASSES OF PERSONS AND ADDRESSES
(Paragraph 1205(3)(a), paragraph 1233(3)(a) and paragraph 1235(3)(a))
 
 
I, CHRIS BOWEN, Minister for Immigration and Citizenship, acting under paragraph 1205(3)(a), paragraph 1233(3)(a) and paragraph 1235(3)(a) of the Migration Regulations 1994 (‘the Regulations’):
 
1.         REVOKE Instrument IMMI 10/010, signed on 3 March 2010, specifying addresses   for the purposes of paragraph 1205(3)(ba); AND
 
2.         REVOKE Instrument IMMI 09/097, signed on 16 October 2009, specifying addresses for the purposes of paragraph 1208(3)(bd); AND
 
3.         SPECIFY the following for the purposes of subparagraphs 1205(3)(a)(i), (ii) and (iii) relating to an applicant who seeks to satisfy the criteria for the grant of a Subclass 416 (Special Program) visa:

This Instrument, IMMI 12/085 commences on 24 November 2012, immediately after the commencement of Migration Legislation Amendment Regulation (No. 4).

[NOTE 1:  Paragraph 1205(3)(a) of the Regulations provides that an application by a person seeking to meet the criteria for the grant of a Subclass 416 (Special Program) visa must be made by posting the application (with the correct pre-paid postage) to the post office box address specified in an instrument in writing for subparagraph 1205(3)(a)(i), having the application delivered by a courier service or by hand to the address specified in an instrument in writing for subparagraph 1205(3)(a)(ii), or having the application sent by facsimile to the address specified in an instrument in writing for subparagraph 1205(3)(a)(iii).
NOTE 2:   Paragraph 1233(3)(a) of the Regulations provides that an application by a person seeking to meet the criteria for the grant of a Subclass 402 (Training and Research) visa must be made, for an applicant in a class of persons specified by the Minister in an instrument in writing, by posting the application (with the correct pre-paid postage) to the post office box address specified in an instrument in writing for subparagraph 1233(3)(a)(i), or for an applicant in a class of persons specified by the Minister in an instrument in writing, by having the application delivered by a courier service or by hand to the address specified in an instrument in writing for subparagraph 1233(3)(a)(ii), or for an applicant in a class of persons specified by the Minister in an instrument in writing, by having the application sent by facsimile to the address specified in an instrument in writing for subparagraph 1233(3)(a)(iii), or for an applicant in a class of persons specified by the Minister in an instrument in writing, by having the application delivered to a diplomatic, consular or migration office maintained by or no behalf of the Commonwealth outside Australia for subparagraph 1233(3)(a)(iv).
NOTE 3:   Paragraph 1235(3)(a) of the Regulations provides that an application by a person seeking to meet the criteria for the grant of a Subclass 420 (Temporary Work (Entertainment)) visa must be made by posting the application (with the correct pre-paid postage) to the post office box address specified in an instrument in writing for subparagraph 1235(3)(a)(i), having the application delivered by a courier service or by hand to the address specified in an instrument in writing for subparagraph 1235(3)(a)(ii), or having the application sent by facsimile to the address specified in an instrument in writing for subparagraph 1235(3)(a)(iii).
NOTE 4:   Paragraph 1205(3)(ba) is repealed from the Migration Regulations 1994 by the Migration Legislation Amendment Regulation 2012 (No. 4), with effect from 24 November 2012]
