Exemption — ARFFS PST Diploma
1          Duration
                 This instrument:
(a)   commences on the day after registration; and
(b)   stops having effect at the end of 30 June 2015.
2          Application
                 This instrument applies to:
(a)   Airservices Australia (AA), an approved Aerodrome Rescue and Fire Fighting Services (ARFFS) provider, in providing firefighting services at aerodromes; and
(b)   each shift supervisor at an aerodrome where AA provides ARFFS.
3          Exemption
                 AA is exempt from compliance with the provisions of subregulation 139.845 (1) of CASR 1998, to the extent mentioned in Schedule 1.
Note   Paragraph 18.1.1.10 of Manual of Standards (MOS) Part 139H requires that all shift supervisors on a staff of operational fire fighters hold an ARFFS Australian Fire Competency (AFC) Diploma.
4          Conditions
                 The exemption is subject to the conditions mentioned in Schedule 2.
Schedule 1          Extent of exemption
              The exemption extends only to the requirement to comply with paragraph 18.1.1.10 of MOS Part 139H.
Schedule 2          Conditions
               AA must:
(a)   ensure that a person with a Certificate IV qualification acts in the capacity of supervisor only at a location that requires 2 or more officers to maintain the appropriate category level of service; and
(b)   ensure that a Certificate IV qualified person is only able to act as the 2nd officer-in-charge when a Diploma qualified person is, for any reason, unavailable; and
(c)   ensure that a Certificate IV qualified person, when working as the 2nd officer-in-charge, is under the general supervision of the 1st officer who must be a person who holds the required Diploma qualification.
