Exemption — overweight landings
1          Duration
                 The instrument:
(a)   commences on the day of registration; and
(b)   stops having effect at the end of 31 July 2014.
2          Definitions
                 In this instrument:
non-normal situation means any of the following situations requiring the pilot in command to land the aircraft before its intended destination:
(a)   any malfunction that would render the aircraft not airworthy;
(b)   any condition, or combination of conditions (mechanical or otherwise), in which an expeditious landing would reduce the exposure to potential additional problems which may result in a derogation or compromise of safety;
(c)   serious illness of crew member or passenger which requires immediate medical attention.
overweight landing means a landing made at a gross weight in excess of the maximum design (i.e. structural) landing weight for the particular model of aircraft.
3          Application
                 This instrument applies to the pilot in command of an A330 or A380 aircraft operated by Qantas Airways Limited (Qantas), Aviation Reference Number 216147, when he or she elects to undertake an overweight landing in a non-normal situation.
4          Exemption
                 The pilot in command of an A330 or A380 aircraft operated by Qantas is exempt from compliance with the requirements of subregulation 235 (6) of the Civil Aviation Regulations 1988 when undertaking a landing in a non-normal situation.
5          Conditions
                 The exemption is subject to the conditions mentioned in Schedule 1.
Schedule 1          Conditions
        1     The pilot in command must comply with the Qantas autoland approval if conducting an autoland.
        2     For the A380, the pilot in command may use autoland up to the maximum structural take-off weight.
        3     For the A330, the pilot in command may use autoland up to the maximum structural take-off weight less 4 000 kgs.
        4     The pilot in command must comply with all the performance requirements in Civil Aviation Order 20.7.1B.
        5     If the pilot in command performs an overweight landing in a non-normal situation, Qantas must ensure that an overweight landing inspection is carried out in accordance with the Aircraft Maintenance Manual.
