I, KIM BESSELL, Assistant Secretary, Pharmaceutical Access Branch, Pharmaceutical Benefits Division, Department of Health and Ageing, delegate of the Minister for Health, make this Amendment Instrument under subsections 100(1) and 100(2) of the National Health Act 1953.

1              Name of Instrument
 
(1)                This Instrument is the National Health (Indigenous Chronic Disease – PBS Co-payment Measure)) Special Arrangement Amendment Instrument 2012 (No.1).
 
(2)                This Instrument may also be cited as PB 43 of 2012.
 
2              Commencement
This Instrument commences on 1 July 2012.
3              Amendments to PB 22 of 2012
Schedule 1 amends the National Health (Indigenous Chronic Disease – PBS Co-payment Measure) Special Arrangement 2012 (PB 22 of 2012).
 
 
Schedule 1                   Amendments
[1]     Section 4, after definition for medical practitioner
insert:
medication chart prescription has the meaning given in the Regulations.
[2]     Section 4, after definition for other Special Arrangement
insert:
paperless claim for payment has the meaning given in the Regulations.
[3]     Section 4, after definition for referred
insert:
Regulations means the National Health (Pharmaceutical Benefits) Regulations 1960.
[4]     Section 4, after definition for specialist
insert:
supply certification form has the meaning given in the Regulations.
[5]     After subsection 6(2)

(3)    This Special Arrangement does not apply to continued dispensing under subsection 89A(1) of the Act.

Note: This Special Arrangement applies to a supply under subsection 93A(4) of the Act on the basis of a medication chart prescription.
[7]     Paragraph 15(2)(b)
substitute:
(b)       unless made using the manual system:
(i)          must include an indicator that the claim is being made for the supply of a pharmaceutical benefit under this Special Arrangement;
(ii)        if subsection 14(3) or (5) of this Special Arrangement applies, the prescription is not required to be included with the claim, the claim is a paperless claim for payment and the supply certification form is not required to be included in the claim; and
(iii)      if the pharmaceutical benefit is supplied under subsection 93A(4) of the Act on the basis of a medication chart prescription, a supply certification form must be included with the paperless claim for payment, unless subparagraph (ii) applies.
Note: Subsections 99AAA(4) and (5) and section 99AAB of the Act provide that an approved supplier must use the Claims Transmission System, unless permitted to use the manual system under section 99AAB of the Act.
