Education Services for Overseas Students Act 2000
I, CHRIS EVANS, Minister for Tertiary Education, Skills, Science and Research,  pursuant to  section 12 of the Education Services for Overseas Students (TPS Levies) Act 2012, prescribe the classes of registered providers who  are exempt from paying one or more components of the TPS levy.

1         Name of determination
                This determination is the Education Services for Overseas Students (TPS Levies) (Levy exemptions) Determination 2012 (No. 1).
 
2         Commencement
                This determination commences at the same time as item 2 of the table under subsection 2(1) of the Education Services for Overseas Students Legislation Amendment (Tuition Protection Service and Other Measures) Act 2012.
 
3         Definitions
                In this determination:
Act means the Education Services for Overseas Students (TPS Levies) Act 2012. base fee component for a registered provider for a year has the meaning given by section 7 of the Act.
risk rated premium component for a registered provider for a year has the meaning given by section 9 of the Act.
Registered provider has the same meaning as it has in section 5 of the Education Services for Overseas Students Act 2000.
State or Territory VET institution has the same meaning as in Regulation 3 of the Education Services for Overseas Students (Registration Charges) Regulations 2011.
Table A provider has the same meaning as in section 16-15 of the Higher Education Support Act 2003.
Government School has the same meaning as in section 4 of the Schools Assistance (Learning Together – Achievement Through Choice and Opportunity) Act 2004.
Registered school means a non-government school (as defined under the Schools Assistance (Learning Together – Achievement Through Choice and Opportunity) Act 2004) registered on CRICOS.
non-government school has the same meaning as in section 4 of the Schools Assistance (Learning Together – Achievement Through Choice and Opportunity) Act 2004.
4         Base fee component - exemption
For subsection 12(a) of the Act, registered schools that have no international students are exempt from the requirement to pay the base fee component (see section 7 of the Act).
5         Risk rated premium component - exemption
For subsection 12(b) of the Act, a class of providers mentioned in an item in the table is exempt from the requirement to pay the risk rated premium component.
