Enabling legislation
 
1.       The Australian Securities and Investments Commission makes this instrument under subsections 205G(6), 341(1), 352(1), 655A(1), 669(1) and 673(1) of the Corporations Act 2001.
 
Title
 
2.       This instrument is ASIC Class Order [CO 12/722].
 
Commencement
 
3.       This instrument commences on the day it is registered under the Legislative Instruments Act 2003.

Variation
 
ASIC Class Order [CO 00/2449]
 
4.       ASIC Class Order [CO 00/2449] is varied as follows:
 
(a)     in Schedule A omit “Australian Stock Exchange”, substitute “ASX”;
 
(b)     in Schedule B  omit “the Electronic Lodgment Facility.”, substitute “ASX Online.”;
 
(c)     in Schedule C omit paragraph 6, substitute:
 
“6.     If a Body wishes or is required to lodge a Document electronically the Body must lodge it through ASX Online in accordance with ASX Guidance Note 20 – “ASX Online” issued on 12 June 2012.”;
 
(d)     omit Schedule D;
 
(e)     under the heading “Interpretation”, omit all the text, substitute:
 
“In this instrument:
 
ASX Online means the electronic lodgment facility which enables bodies included in the official list of ASX to transmit documents to ASX electronically, which is available at https://www.asxonline.com, or such other address as may be notified by ASX from time to time.”.

5.       ASIC Class Order [CO 00/2451] is varied as follows:
 
(a)     omit from the heading “Law”, substitute “Act 2001”;
 
(b)     in the first paragraph:
 
(i)      omit “Corporations Law (Law),”, substitute “Corporations Act 2001 (the Act),”;
 
(ii)     omit “Schedules C and D.”, substitute “Schedule C.”;
 
(c)     in Schedule A:
 
(i)      omit “Law”, substitute “Act”;
 
(ii)     omit “Corporations (Fees) Regulations.”, substitute “Corporations (Fees) Regulations 2001.”;
 
(d)     in Schedule B omit “Australian Stock Exchange”, substitute “ASX”;
 
(e)     in Schedule C:
 
(i)      in paragraph 1 omit “ASIC Practice Note 61, Relief from  dual lodgment of financial reports [PN 61].”, substitute “ASIC Regulatory Guide 28: Relief from dual lodgment of financial reports as at 12 June 2012.”;
 
(ii)     omit paragraphs 2 to 8 (inclusive), substitute:
 
“2.     If a Body wishes to lodge a Document electronically the Body must lodge it through ASX Online in accordance with ASX Guidance Note 20 – “ASX Online” issued on 12 June 2012.
 
3.       A body lodging a Document electronically under the Approval must keep a signed copy of the Document for a period of not less than 7 years from the time of Data Transmission. The Body must make it available to ASIC if required by ASIC.”;
 
(f)      omit Schedule D;
 
(g)     in the table under the heading “Interpretation”:
 
(i)      omit the rows setting out the definitions of the following:
 
(A)    ASX Online User Guide;
 
(B)    Electronic Lodgement Facility;
 
(C)    Security Features;
 
(ii)     insert the following row after the row setting out the definition of Approval:
 
ASX Online
The electronic lodgment facility which enables bodies included in the official list of ASX to transmit documents to ASX electronically, which is available at https://www.asxonline.com, or such other address as may be notified by ASX from time to time.

6.       ASIC Class Order [CO 01/1519] is varied by,             in paragraph 2 of Schedule C, omitting “5 May 2008.” and substituting “12 June 2012.”.
