1              Name of Specification
                This Specification is the Social Security (Essential Medical Equipment Payment – Residences) Specification 2012.
2              Commencement
                This Specification commences on 18 June 2012.
3              Definition
                In this Specification:
                Act means the Social Security Act 1991.
4              EMEP Residences
                Every residence located in Australia that is not a private residence, but is a person’s home is a specified residence in respect of the person for the purposes of paragraphs 917C(1)(a) and (b) of the Act except where it is an excluded residence of a type specified in Schedule 1.
 
 
 Schedule 1       Excluded Residences
A residence in which the person is in residential care for the purposes of the Act
Hospital or other medical facility
Residential rehabilitation centre
Gaol, or any place in which a person may be lawfully detained while under sentence for conviction of an offence and not on release on parole or licence
Detention Centre
