Part 1—Preliminary
  
1  Name of determination
                   This determination is the Aged Care (Flexible Care Subsidy Amount – Innovative Care) Determination 2013 (No. 2).
2  Commencement
                   This determination commences on 1 August 2013.
3  Authority
                   This determination is made under the Aged Care Act 1997.
4  Repeal       
                   The Aged Care (Amount of Flexible Care Subsidy – Innovative Care Services) Determination 2013 (No. 1), made by the Minister on 27 June 2013, also known as F2013L01287, is repealed.
                   The Aged Care (Amount of Flexible Care Subsidy-Innovative Care Service- Congress Community Development and Education Unit Ltd) Determination 2012 (No. 1), made by the Minister on 22 June 2012, also known as F2012L01422, is repealed.
 
5  Definitions
                   In this determination:
Act means the Aged Care Act 1997.
dementia and cognition supplement means the dementia and cognition supplement referred to in Division 2.5 of the Aged Care (Home Care Subsidy Amount) Determination 2013;
eligible care recipient means a care recipient who would be eligible for either the dementia and cognition supplement or the veterans’ supplement if the care recipient were receiving home care;
veterans’ supplement means the veterans’ supplement referred to in Division 2.6 of the Aged Care (Home Care Subsidy Amount) Determination 2013.
Part 2—Care recipients receiving innovative care services
  
6  Amount of flexible care subsidy – approved providers in Schedule 1
                   For subsection 52-1(1) of the Act, the amount of flexible care subsidy payable for a care recipient receiving innovative care services of a kind specified in section 15.24 of the Flexible Care Subsidy Principles 1997 provided by an approved provider listed in Column 1 of the table in Schedule 1 in respect of a day is the sum of:
                     (a)  the amount mentioned in Column 2 of the table in Schedule 1 for that approved provider; and
                     (b)  if the care recipient is an eligible care recipient, 10% of the basic subsidy amount that would be payable under section 7 of the Aged Care Home Care Subsidy Amount) Determination 2013 if the care recipient were a recipient of level 4 home care.
7  Amount of flexible care subsidy – approved providers in Schedule 2
                   For subsection 52-1(1) of the Act, the amount of flexible care subsidy payable for a care recipient receiving innovative care services of a kind specified in section 15.24 of the Flexible Care Subsidy Principles 1997 provided by an approved provider listed in Column 1 of the table in Schedule 2 in respect of a day is the sum of:
                     (a)  the amount mentioned in Column 2 of the table in Schedule 2 for that approved provider; and
                     (b)  if the care recipient is an eligible care recipient, 10% of the basic subsidy amount that would be payable under section 7 of the Aged Care Home Care Subsidy Amount) Determination 2013 if the care recipient were a recipient of level 2 home care.
