I, STEPHEN MICHAEL CONROY, Minister for Broadband, Communications and the Digital Economy, make this Determination under subclause 21A(2) of Schedule 4 to the Broadcasting Services Act 1992.

1.             Name of instrument
This Determination is the Broadcasting Services (Exempt Digital Transmission Areas) Determination (No. 2) 2013.
2.             Commencement
This Determination commences on the day it is registered on the Federal Register of Legislative Instruments.
3.             Definitions
3.1         In this Determination:
 
ABC means the Australian Broadcasting Corporation;
 
Act means the Broadcasting Services Act 1992;
 
Argyle Transmission Site means the location at 16 degrees, 42 minutes and 36 seconds south latitude and 128 degrees, 23 minutes and 45 seconds east longitude, which is known as the Broadcast Site SMOKE CREEK, with the Site Identification Number 151786, as identified in the Register of Radiocommunications Licences;
 
Bayulu Transmission Site means the location at 18 degrees, 17 minutes and 28 seconds south latitude and 125 degrees, 35 minutes and 15 seconds east longitude, which is known as the Broadcast Site Trig Point 0.5 km N of BAYULU, with the Site Identification Number 151735, as identified in the Register of Radiocommunications Licences;
 
Brisbane TV1 licence area means the area described in the Licence Area Plan - Brisbane Analog Television – November 2002 made by the Australian Communications and Media Authority under subsection 26(1) of the Act;
 
Condingup/Howick Transmission Site means the location at 33 degrees, 45 minutes and 39 seconds south latitude and 122 degrees, 32 minutes and 55 seconds east longitude, which is known as the Broadcast/Comm Site Condingup Peak CONDINGUP, with the Site Identification Number 30178, as identified in the Register of Radiocommunications Licences;
 
Eneabba Transmission Site means the location at 29 degrees, 49 minutes and 09 seconds south latitude and 115 degrees, 16 minutes and 34 seconds east longitude, which is known as the Broadcast Site Town Water Site ENEABBA, with the Site Identification Number 41033, as identified in the Register of Radiocommunications Licences;
Geraldton TV1 licence area is the area determined by the Australian Communications and Media Authority in Licence Area Plan: Remote and Regional Western Australia (Television) – February 1997 under subsection 26(1) of the Act;
Kalgoorlie TV1 licence area means the area determined by the Australian Communications and Media Authority in Licence Area Plan: Remote and Regional Western Australia (Television) – February 1997 under subsection 26(1) of the Act;
Moore Transmission Site means the location at 26 degrees, 53 minutes and 45 seconds south latitude and 152 degrees, 17 minutes and 27 seconds east longitude, which is known as the Broadcast Site 1 Main St Sth MOORE, with the Site Identification Number 9011788, as identified in the Register of Radiocommunications Licences;
 
Regional Queensland TV1 licence area is the area determined by the ACMA in the Licence Area Plan Regional Queensland Analog Television made under subsection 26(1) of the Act;
 
Register of Radiocommunications Licences refers to the register established and maintained by the Australian Communications and Media Authority in accordance with section 143 of the Radiocommunications Act 1992 and the Radiocommunications (Register of Radiocommunications Licences) Determination 1997;
Remote and Regional WA TV1 licence area is the area determined by the Australian Communications and Media Authority in Licence Area Plan: Remote and Regional Western Australia (Television) – February 1997 under subsection 26(1) of the Act;
Salmon Gums Transmission Site means the location at 33 degrees, 07 minutes and 17 seconds south latitude and 121 degrees, 37 minutes and 25 seconds east longitude, which is known as the Broadcast/Communal Site Red Lake 15 km S of SALMON GUMS, with the Site Identification Number 30113, as identified in the Register of Radiocommunications Licences; and
 
Western Zone TV1 licence area is the area determined by the Australian Communications and Media Authority in Licence Area Plan: Remote and Regional Western Australia (Television) – February 1997 under subsection 26(1) of the Act.
 
3.2         Unless the contrary intention appears, a word or phrase in this Determination has the same meaning as it has in the Act.
4.             Determination
4.1         For the purposes of subclause 21A(2) of Schedule 4 to the Act, each area specified in column 2 of the following table is an exempt digital transmission area in relation to the national broadcaster specified in column 3:
