I, STEPHEN MICHAEL CONROY, Minister for Broadband, Communications and the Digital Economy make this Determination under subclause 9A(2) and subclause 21A(2) of Schedule 4 to the Broadcasting Services Act 1992.

1.             Name of instrument
This Determination is the Broadcasting Services (Exempt Digital Transmission Areas) Determination (No. 1) 2013.
2.             Commencement
This Determination commences on the day it is registered on the Federal Register of Legislative Instruments.
3.             Definitions
3.1         In this Determination:
 
ABC means the Australian Broadcasting Corporation;
 
Act means the Broadcasting Services Act 1992;
 
Avoca Transmission Site means the location at 41 degrees, 46 minutes and 48 seconds south latitude and 147 degrees, 43 minutes and 35 seconds east longitude, which is known as the Broadcast Site Water Tank AVOCA, with the Site Identification Number 150557, as identified in the Register of Radiocommunications Licences;
 
Kalgoorlie TV1 licence area means the area determined by the Australian Communications and Media Authority in Licence Area Plan: Remote and Regional Western Australia (Television) – February 1997 under subsection 26(1) of the Act;
 
Koolyanobbing Transmission Site means the location at 30 degrees, 50 minutes and 30 seconds south latitude and 119 degrees, 32 minutes and 30 seconds east longitude, which is known as the Broadcast Wundowie Hills 2.4km S of KOOLYANOBBING, with the Site Identification Number 151306, as identified in the Register of Radiocommunications Licences;
 
Mangana Transmission Site means the location at 41 degrees, 36 minutes and 57 seconds south latitude and 147 degrees, 53 minutes and 00 seconds east longitude, which is known as the Broadcast Site MANGANA SOUTH, with the Site Identification Number 150615, as identified in the Register of Radiocommunications Licences;
 
Perenjori Transmission Site means the location at 29 degrees, 26 minutes and 58 seconds south latitude and 116 degrees, 17 minutes and 51 seconds east longitude, which is known as the Broadcast Site 1km SE of PERENJORI, with the Site Identification Number 41178, as identified in the Register of Radiocommunications Licences;
 
Pyengana Valley Transmission Site means the location at 41 degrees, 17 minutes and 24 seconds south latitude and 148 degrees, 00 minutes and 55 seconds east longitude, which is known as the Broadcast Site Le Fevre Hill PYENGANA, with the Site Identification Number 150553, as identified in the Register of Radiocommunications Licences;
 
Register of Radiocommunications Licences refers to the register established and maintained by the Australian Communications and Media Authority in accordance with section 143 of the Radiocommunications Act 1992 and the Radiocommunications (Register of Radiocommunications Licences) Determination 1997;
 
Remote and Regional WA TV1 licence area is the area determined by the Australian Communications and Media Authority in Licence Area Plan: Remote and Regional Western Australia (Television) – February 1997 under subsection 26(1) of the Act;
 
Remote Central and Eastern Australia TV1 licence area is the area determined by the Australian Communications and Media Authority in Licence Area Plan –Remote Central & Eastern Australia Television – December 1996 under subsection 26(1) of the Act (as varied from time to time);
 
Savage River Transmission Site means the location at 41 degrees, 27 minutes and 5 seconds south latitude and 145 degrees, 22 minutes and 35 seconds east longitude, which is known as the Broadcast Site Mt Cleveland LUINA, with the Site Identification Number 34258, as identified in the Register of Radiocommunications Licences;
 
South Springfield Transmission Site means the location at 41 degrees, 14 minutes and 10 seconds south latitude and 147 degrees, 30 minutes and 52 seconds east longitude, which is known as the TV Translator Beatties Road (south of Scottsdale) SPRINGFIELD, with the Site Identification Number 152585, as identified in the Register of Radiocommunications Licences;
 
Strathgordon Transmission Site means the location at 42 degrees, 46 minutes and 39 seconds south latitude and 146 degrees, 04 minutes and 02 seconds east longitude, which is known as the Broadcast Site Twelve Trees Range STRATHGORDON, with the Site Identification Number 33149, as identified in the Register of Radiocommunications Licences;
 
Tasmania TV1 licence area is the area determined by the Australian Communications and Media Authority in Licence Area Plan: Tasmania Television – July 2002 under subsection 26(1) of the Act; and
 
Weldborough Transmission Site means the location at 41 degrees, 14 minutes and 06 seconds south latitude and 147 degrees, 56 minutes and 37 seconds east longitude, which is known as the TV Translator Site near trig station WELDBOROUGH PASS, with the Site Identification Number 150554, as identified in the Register of Radiocommunications Licences.
 
3.2         Unless the contrary intention appears, a word or phrase in this Determination has the same meaning as it has in the Act.
4.             Determination
4.1         For the purposes of subclause 9A(2) of Schedule 4 to the Act, each area specified in column 2 of the table in Schedule 1 is an exempt digital transmission area in relation to the commercial television broadcasting licence with the service licence number specified in column 3 at the same item of the table in Schedule 1.
4.2         For the purposes of subclause 21A(2) of Schedule 4 to the Act, each area specified in column 2 of the table in Schedule 2 is an exempt digital transmission area in relation to the national broadcaster specified in column 3 at the same item of the table in Schedule 2.
