NATION BUILDING PROGRAM ROADS TO RECOVERY PROGRAM CONDITIONS VARIATION FC2013/1
 
 
I, ALEXANDER EDWARD FOULDS, General Manager, South East Roads, Department of Infrastructure and Transport, under section 90(5) of the Nation Building Program (National Land Transport) Act 2009 (the Act), vary the Determination of Conditions Applying to Payments under Part 8 which was made by the Minister on 9 September 2009 and previously varied on 25 November 2010 and 19 April 2011.

1.      Name of variation
 
This variation instrument is the Nation Building Program Roads to Recovery Program Conditions Variation FC2013/1.
 
2.      Variation
 
The Determination of Conditions Applying to Payments under Part 8 is varied as follows:
 
(a)        in subclause 3.1, omit ‘subclauses 3.3 and 3.4’, substitute ‘subclauses 3.2 and 3.3’;
 
(b)        in subclause 3.2:
(i)         omit ‘cl.3.2’, substitute ‘subclause 3.1’; and
(ii)        omit ‘subclause 3.2’, substitute ‘subclause  3.1’; and
 
(c)        in subclause 3.3:
(i)         omit ‘the requirements of clauses 3.2 or 3.3’, substitute ‘subclause 3.1 or 3.2’; and
(ii)        omit ‘clause 3.2’, substitute ‘subclause 3.1’.
