I, STEPHEN michael CONROY, Minister for Broadband, Communications and the Digital Economy, make the following Determination under subsection 92(2) of the Telecommunications Universal Service Management Agency Act 2012.

1     Name of Determination
This Determination is the Telecommunications (Participating Persons) Determination 2013.
2    Commencement
This Determination commences on the day after it is registered on the Federal Register of Legislative Instruments.
3   Application
This Determination only applies in relation to the eligible revenue period for the 2011-12 financial year.
4    Definitions
In this Determination:
Act means the Telecommunications Universal Service Management Agency Act 2012.
Existing Participating Persons Determination means the Telecommunications (Participating Persons) Determination 2011 (No. 1) made under paragraph 20A(2)(b) of the TCPSS Act.
TCPSS Act means the Telecommunications (Consumer Protection and Service Standards) Act 1999.
USO non-participating person has the same meaning as in subsection 4(4) of the Existing Participating Persons Determination.
Note: The terms eligible revenue period and participating person have the same meaning given by section 4 of the Act.
5    Determination
If a person is a USO non-participating person under the Existing Participating Persons Determination for the 2011-12 eligible revenue period, the person is exempt from section 92 of the Act for that eligible revenue period.
