Exemption — Employment of part-time check pilots (Capiteq Limited)
1          Duration
                 This instrument:
(a)   commences on the day of registration; and
(b)   expires at the end of August 2017, as if it had been repealed by another instrument.
2          Application
                 This exemption applies to Capiteq Limited, trading as Airnorth, Aviation Reference Number 518845 (the operator), regarding the employment of check pilots, training pilots, or check and training pilots (check pilot).
3          Exemption
                 The operator is exempt from compliance with paragraph 2.4 of Appendix 2 of Civil Aviation Order 82.5, but only to the extent that it requires a check pilot to be in the full-time employment of the operator.
4          Conditions
                 The exemption is subject to the conditions in Schedule 1. 
Schedule 1          Conditions
              The operator must ensure that for any person who is appointed as a check pilot with the operator’s training and checking organisation and who is employed by another person (the contractor), the following requirements are met:
(a)   a contract for services must be in place between the operator and the contractor relating to the duties to be carried out by the check pilot;
(b)   the check pilot must be inducted into, and be maintained as part of, the operator’s training and checking organisation in accordance with the operator’s operations manual;
(c)   the operator must assign the duties to be carried out by the check pilot;
(d)   the check pilot must be responsible for ensuring that his or her assigned duties are satisfactorily carried out in accordance with the operator’s requirements;
(e)   the operator must not require the check pilot to carry out duties in addition to those assigned, except that the check pilot may compile and complete such reports relating to the conduct of the contract as the operator or the contractor may reasonably require.
