Exemption — aerial application rating and firefighting endorsement
1          Duration
                 This instrument:
(a)   commences on the day of registration; and
(b)   expires at the end of August 2015, as if it had been repealed by another instrument.
2          Definitions
                 In this instrument:
AOC means Air Operator’s Certificate.
firefighting operation means an operation involving the dropping of water and fire retardant.
operator means the holder of an AOC which authorises the conduct of firefighting operations.
pilot means the holder of any 1 or more of the licences specified in section 3 of this instrument.
3          Application
                 This instrument applies to the holder of:
(a)   a commercial pilot licence (aeroplane); and
(b)   an air transport pilot licence (aeroplane); and
(c)   a commercial pilot licence (helicopter); and
(d)   an air transport pilot licence (helicopter);
                 conducting firefighting operations from 1 September 2014.
4          Exemption
        (1)     The pilot is exempt from subregulation 61.065 (1) of CASR 1998, but only in relation to firefighting operations.
        (2)     The pilot is exempt from regulation 61.375 of CASR 1998, but only to the extent that the pilot is required to hold an aerial application rating in accordance with item 6 of Table 61.375 to conduct a firefighting operation in a helicopter.
        (3)     The pilot is exempt from regulation 61.1100 of CASR 1998, but only to the extent that the pilot is required to:
(a)   hold an aeroplane firefighting endorsement in accordance with item 4 of Table 61.1120; and
(b)   hold a helicopter firefighting endorsement in accordance with item 5 of Table 61.1120.
5          Conditions
                 The exemptions are subject to the conditions mentioned in Schedule 1.
Schedule 1          Conditions
      1     The firefighting operation conducted by the pilot must be conducted under an AOC that authorises firefighting operations.
      2     The pilot must have undertaken training in firefighting operations that was provided by an operator in accordance with its operations manual.
      3     Within the previous 6 months, the pilot must have been assessed in accordance with the procedures in the operator’s operations manual or training and checking manual as being competent to conduct firefighting operations in aircraft operated by the operator and in accordance with the operator’s operations manual.
      4     For aeroplane firefighting operations, the pilot must hold or must be deemed to hold an aerial application rating (aeroplane category) under Part 61 of CASR 1998.
      5     For helicopter firefighting operations involving a sling operation, the pilot must hold, or must be deemed to hold, a low-level rating and sling operations endorsement under Part 61 of CASR 1998 to conduct a sling operation.
