I, FIONA NASH, Assistant Minister for Health, make this determination under subsection 8(7) and 8(8) of the Australian Hearing Services Act 1991.

Part 1        Preliminary
 
1.               Name of Determination
 
This Determination is the Declared Hearing Services Amendment Determination 2014 (No. 1).
 
2.               Commencement
 
Each provision of this Determination specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Immediately after the commencement of the Declared Hearing Services Amendment Determination 2013 (No. 1).

3.               Authority
 
This Determination is made under the Australian Hearing Services Act 1991.
 
4.               Schedules
 
Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
 
Schedule 1
 
Declared Hearing Services Determination 1997
 
1         Subparagraph 12(d)(vi)
 
             Repeal the subparagraph, substitute:
 
             (vi)        a person who:
 
A.    was a participant in the CDEP Program at any time on or after 30 June 2013; and
B.     has ceased to be a participant; and
C.     before ceasing to be a participant had received or was part-way through receiving from the Authority one or more of the hearing services specified in Part 8 of Schedule 1; or
 
             (vii)       a participant in the CDEP Program;

Omit “Families, Housing, Community Services and Indigenous Affairs”, insert “the Prime Minister and Cabinet”.
 
2         Subsection 3(1) (definition of RJCP)
 
Omit “Families, Housing, Community Services and Indigenous Affairs and the Department of Education, Employment and Workplace Relations”, insert “the Prime Minister and Cabinet”.
 
3         Schedule 1, Part 7, item 2A
 
After “a hearing device”, insert “ (other than a cochlear implant or a cochlear implant speech processor unit)”.
 
4         Schedule 1, Part 8, item 2A
            
After “a hearing device”, insert “ (other than a cochlear implant or a cochlear implant speech processor unit)”.
