I, JAMIE EDWARD BRIGGS, Assistant Minister for Infrastructure and Regional Development, determine this vehicle standard under section 7 of the Motor Vehicle Standards Act 1989.

1.1.                                    Name of Legislative Instrument
1.1.1.                              This instrument is the Vehicle Standard (Australian Design Rule 4/05 – Seatbelts) 2012 Amendment 1.
1.2.                                    Commencement
1.2.1.                              This instrument commences on the day after it is registered.
2.                                          amendment of vehicle standard
2.1.                                    The changes specified in Schedule 1 amend Vehicle Standard (Australian Design Rule 4/05 – Seatbelts) 2012.
 
 
Schedule 1
[1]               Clause 5.1 amend to read:
“5.1          Vehicles subject to the requirements of this standard must comply with the requirements of Appendix A, except as varied by Section 6 Exemptions and Alternative Procedures.”               
[2]               Clause 7.2 amend to read:
“7.2          Provided clause 5.3 is met, the technical requirements adopted by the United Nations - Economic Commission for Europe Regulation No. 16 – UNIFORM PROVISIONS CONCERNING THE APPROVAL OF: I.            SAFETY-BELTS, RESTRAINT SYSTEMS, CHILD RESTRAINT SYSTEMS AND ISOFIX CHILD RESTRAINT SYSTEMS FOR OCCUPANTS OF POWER-DRIVEN VEHICLES and II. Vehicles equipped with safety-belts, safety-belt reminder, restraint systems, child restraint systems and ISOFIX child restraint systems, incorporating the 05 series of amendments, shall be deemed to be equivalent to the technical requirements of this standard in all respects except the installation and the type of safety‑belt(s) fitted for folding seats.”
[3]               Clause 7.3 renumber as 7.4.
[4]               Clause 7.4 renumber as 7.5.
[5]               Insert a new clause 7.3 to read:
“7.3          The technical requirements adopted by the United Nations - Economic Commission for Europe Regulation No. 16 – UNIFORM PROVISIONS CONCERNING THE APPROVAL OF: I.    SAFETY-BELTS, RESTRAINT SYSTEMS, CHILD RESTRAINT SYSTEMS AND ISOFIX CHILD RESTRAINT SYSTEMS FOR OCCUPANTS OF POWER-DRIVEN VEHICLES and II. VEHICLES EQUIPPED WITH SAFETY-BELTS, SAFETY-BELT REMINDER, RESTRAINT SYSTEMS, CHILD RESTRAINT SYSTEMS AND ISOFIX CHILD RESTRAINT SYSTEMS, incorporating the 04 series of amendments from supplement 12 onwards, up to and including the 06 series of amendments, for the approval of a safety-belt type and/or a restraint system, shall be deemed to be equivalent to the technical requirements of Appendix A, paragraph 5.3.1, Section 6 (Specifications) and Section 7 (Tests) of this standard.”
