The present Law regulates the order, recruitment, preparation, the order of fighting application, competence and organizational basis and principles of activities of the Civil Defence Troops of the Republic of Armenia.

Chapter I

General provisions

Article 1. Civil Defence Troops

The Civil Defence Troops are the military units of the permanent preparedness equipped with special techniques, uniforms, individual protection means, and envisaged for protection of population, organizations and participation in the defence in Republic of Armenia during the fighting activities or during the elimination of their consequences.

The units of the Civil Defence Troops have the fighting flag approved by the Government of the Republic of Armenia.

The special techniques of the Civil Defence Troops have the distinguishing badges approved by the Government of the Republic of Armenia.

Article 2. The legal basis of the Civil Defence Troops activities

The legal basis of the Civil Defence Troops activities are the Constitution of the Republic of Armenia, International agreements of the Republic of Armenia, present Law, other laws and legal acts of the Republic of Armenia.

Article 3. The basic concepts applied in present law

The basic concepts applied in present law have the following meanings:

Decontamination - elimination and removal infectious illnesses stimulants;

Special techniques - transport, technical means and devices envisaged for the implementation of activities on civil defence and elimination of the consequences of emergencies;

Special development - the protective, engineer - technical organizational measures aimed at deactivation, degasification, decontamination of the techniques, devices and constructions;

Sanitation working out - mechanical cleaning of the skin coverage, mucous membranes of the infected people, as well as decontamination of their clothes, booths, when they leave disaster area.

Article 4. Principles of Civil Defence Troops activities

The activities of the Civil Defence Troops are implemented according to the principles of legitimacy, personal management, cooperation with Governmental bodies and organizations included in the civil defence structure and protection of the citizens rights.

Article 5. Civil Defence Troops objectives

The objectives of the Civil Defence Troops are:

1. Implementation of the Civil defence activities during the fighting operations or elimination of their consequences;

2. Participation in the works of elimination of the consequences of emergencies;

3. Participation in the defence of the Republic of Armenia.

Article 6. Civil Defence Troops Command

The Civil Defence Troops function in the structure of state governing body authorized in emergency management and civil defence area (herein forth the authorized body).

The Civil Defence Troops command during the participation in the fighting operations is implemented by the chief of the authorized body and by the Armed Forces Command of the Republic of Armenia.

Article 7. Civil Defence Troops structure and personnel strength

The structure and personnel strength of the Civil Defence Troops is approved by the Government of the Republic of Armenia by the presentation of authorized body.

Article 8. The obligations of State, Local Self Governing Bodies, organizations and officials in the sphere of Civil Defence Troops support

State, Local Self-Governing Bodies, organizations and officials within the limits of their competence provide the support to the Civil Defence Troops in the sphere of their obligations implementation.

The landing, stay, loading, preparation for the flight and flight of the airbuses fulfilling the special flight commitments as well as international humanitarian support provision in the emergencies for the implementation of Civil Defence Troops objectives are implemented by the order defined by the Government of the Republic of Armenia.

The officials of the State Governmental bodies authorized in the sphere of transport of the Republic of Armenia, the orderly officers, the employers of the State inspections of the State Governmental authorized bodies provide the free, out of turn transportation and traffic security of the servicemen of the Civil Defence Troops.

The State and local self governing bodies, organizations and officials provide support in the sphere of primarily use of their communication means by the Civil Defence Troops during the marital law or emergencies legal regime.

The medical provision of the Civil Defence Troops during their obligations implementation is carried out by the Health organizations.

 

Chapter II


The civil defnece troops competence

 Article 9. The rights of the Civil Defence Troops

During their activities the Civil Defence Troops have the right:

1.During the rescue and other urgent accidents reconstruction works implementation to have a free access to the territories of the organizations, and in the exclusive cases in the flats of the citizens', to open the locked doors, windows, to destruct the fences, constructions, if there existence hinders the rescue operations implementations or can cause the grave consequences.

2.Temporarily to confine restrict the movement of the persons or transport means for the purpose of people health and life preservation.

3.Primarily to use the contact means and communication ways with the future equivalent reimbursement for the organization and implementation of the Civil defence activities and rescue operations.

4.To construct buildings, constructions, engineer-technical construction, training objects, logistic base objects, to stretch the communication lines, to distribute and apply the techniques in the land areas provided to them by the order defined by law.

5.To participate in activities of elimination and reduction of the consequences of emergencies out of the territory of the Republic of Armenia by the order defined by law.

6.To apply any necessary equipment (irrespective of belonging ) and trained dogs during implementation of the rescue and urgent accident reconstruction operations.

7.The application of fighting weapon according to the order defined by the legislation of the Republic of Armenia.

8.To suspend the activities of the persons which can hinder the implementation of the civil defence and emergences elimination measures.

During participation in the defence of the Republic of Armenia the Civil Defence Troops are equipped with weapon, armament and fighting techniques according to the order defined for the Armed Forces of the Republic of Armenia.

Article 10. Physical force application

To overcome the resistance to the submitted demands during the crimes prevention the servicemen of the Civil Defence Troops have the right to apply the physical force within the frames of their authorities if otherwise can not implement their duties.

Article 11. Application and Carrying of weapon

The servicemen of the Civil Defence Troops personally or in the structure of unit have the right to apply weapon:

1.Making retreat the attacks on the servicemen of the Civil Defence Troops, employers of the authorized body unites if there is a real risk to their life or health.

2.Preventing the attempts to seize their weapon.

3.Rendering harmless the rabid and wild animals, which can coast danger for human life and health.

4.Stopping the transport mean by the defined order during the martial law or emergency legal regime conditions when the driver does not commit the demand of the relevant authorized bodies.

5.Without warning while implementing the objectives defined by the Article 12, point 5 of the present law.

The weapon is applied in the conditions defined by the points 1, 2, 4 of the 1st part of the present Article 1. If the delinquents do not abbey after ,,freeze'' command and shooting in the air.

The servicemen of the Civil Defence Troops have the right to apply weapon implementing their military duties according to the order defined by the legislation of the Republic of Armenia.

It is restricted for the Civil Defence Troops to apply weapon against the women with visible signs of pregnancy, handicapped persons and juveniles (except the cases when they carry out dangerous armed and group attacks against citizens life or perform armed resistance).

The order of the Civil Defence Troops which should participate in elimination of the emergencies consequences or civil defence activities out of the territory of Armenia and equipped with weapon and special techniques, which go out of the Republic of Armenia or return to the Republic of Armenia is defined by the Government of the Republic of Armenia.

Weapon carrying and application by the Civil Defence Troops out of the territory of the Republic of Armenia is regulated by the international Conventions and inter State Agreements.

Article 12. Duties of the Civil Defence Troops

The duties of the Civil Defence Troops are:

1.Rescue and urgent accidents reconstruction works implementation.

2.Implementation of the reconnaissance and distinction of the territories with radiological, chemical, biological contamination.

3.Implementation of the Civil Defence special working out and sanitation working out activities in the radiological, chemical, biological contamination sources.

4.Implementation of the affected population vitality providing activities during the fighting operations and as a result of emergencies.

5.Participation in the defence of the Republic of Armenia.

6.Support provision to the public order maintaining bodies in the areas affected by the fighting operations or in the disaster area (reconstruction activities).

7.Implementation of other civil defence activities defined by law.

Article 13. Responsibility of Civil Defence Troops

The staff of the Civil Defence Troops is brought to justice for not commitment or improper commitment of their duties according to the order defined by law of the Republic of Armenia.

The damage cost to the citizens or organization in the result of illegal operations of the Civil Defence Troops staff is subject to reimbursement according to the law.

Article 14. Fighting application of the Civil Defence Troops

The fighting application of the Civil Defence Troops is implemented according to the order defined by the codes of laws of the Armed Forces of the Republic of Armenia and marital codes of laws of the Civil Defence forces (Charters).

The marital codes of laws of the Civil Defence forces are adopted by law.

Chapter III


Entering the service in the civil defence troops

Article 15. The staff of the Civil Defence Troops

The staff of the Civil Defence Troops consists of servicemen and civil staff.

The military titles are awarded to the servicemen of the Civil Defence Troops according to the order defined by the law of the Republic of Armenia ,,On entering the military service''.

The servicemen of the Civil Defence Troops carry the same uniform, military titles and distinction badges of the Armed Forces of the Republic of Armenia as well as international distinction badges and carry fighting and service weapon.

The military service in Civil Defence Troops and the civilian staff activities are regulated according to the order defined by the legislation of the Republic of Armenia. The certificate confirming the personality and status is given to the Civil Defence Troops military and civilian employers.

The types of certificates confirming the personality and status of the servicemen and the distinction badges of Civil Defence Troops are confirmed by the chief of the authorized body.

Article 16. Civil Defence Troops equipping

The equipping of the Civil Defence Troops by the servicemen and entering military service are implemented according to the laws of the Republic of Armenia on ,,Compulsory military service'' and ,,On entering military service''.

The military service in the Civil Defence Troops is organized according to the codes of laws of the Republic of Armenia on Armed Forces and Civil Defence Troops.

The chief of the authorized body is responsible for the state and quality of Civil Defence Troops equipping, dislocation of the servicemen in the military units and subdivisions, on time and regulated demobilization of the servicemen on term service, which dates have already expired.

The Civil Defence Troops equipping is implemented according to the order defined for the Armed Forces.

Article 17. Civil Defence Troops personal strength Preparation and selection

Preparation, further training and enhancement of qualification of the Civil Defence Troops personal strength are implemented in the training institutions of the Ministry of Defence of the Republic of Armenia, authorized body and other training institutions according to the order defined by the laws of the Republic of Armenia ,,On entering the military service'', and on ,,Education'' as well as they are implemented in the foreign states according to the international agreements of the Republic of Armenia.

For the reason of peculiarities of the service conduction in the Civil Defence Troops the relevant services of the authorized body participate in the personal strength selection for the purpose of Civil Defence Troops equipping with personal strength having necessary professional inclination, moral psychological and physical qualities.

Article 18. Implementation of military service duties of the Civil Defence Troops servicmen

The military service duties of the Civil Defence Troops servicemen are implemented according to the order defied by the codes of laws of the Armed Forces of the Republic of Armenia.

The implementation of the duties defined by the present law by the servicemen of the Civil Defence Troops in the areas contaminated by the radioactive, chemical and biological means and in the disasters zone considered to be a military service.

Chapter IV


The legal and social security of the servicemen and the members of their families

Article 19. The legal security of the Civil Defence Troops servicemen and the members of their families

Solving the civil defence and emergencies elimination problems the servicemen of the Civil Defence Troops are the representatives of the authority and are under the State protection.

The implementation of legal demands of the Civil Defence Troops servicemen, which rose within the frames of their competence is binding for State, State Governing, local-self governing bodies, organizations, authorities, citizens of the Republic of Armenian and foreign citizens as well as for persons having no citizenship. No one except the authorities, authorized by the law has right to intervene in civil defence activities and activities aimed at emergences consequences reduction and elimination.

Hindering the implementation of the duties of the Civil Defence Troops servicemen in the sphere of civil defence and emergences consequences reduction and elimination, non - obedience to the demands submitted by them, the encroachment upon the life, health honour, dignity of the Civil Defence Troops servicemen and the members of their families when they are implementing the mentioned duties.

Article 20. The social security of the Civil Defence Troops servicemen and the members of their families

The issues of the Civil Defence Troops servicemen and the members of their families are regulated by the law of the Republic of Armenia "On social security of servicemen and the members of their families", as well as by the other legal actes of the Republic of Armenia defining the privileges, guaranties and compensations for the servicemen of the Armed Forces of the Republic of Armenia.

Chapter V


Financial and logistics provisionof the Civil Defence Troops

Article 21. Financial provision of the Civil Defence Troops

The financial provision of the Civil Defence Troops is made from the State Budget of the Republic of Armenia and from other sources not restricted by the legislation of the Republic of Armenia.

Article 22. The Logistics provision of the Civil Defence Troops

The Civil Defence Troops are provided with necessary military equipment, special techniques according to the order defined y the Government of the Republic of Armenia.

The repair of the military and special techniques of the Civil Defence Troops is done in the relevant subdivisions of the body authorized in the sphere of defence of the Republic of Armenia and other specialized organizations.
