No. 13 of 2003

AN ACT to amend the Passenger Facilty Charge Act, 2002.

[ 4th December, 2003 ]

ENACTED by the Parliament of Antigua and Barbuda as
follows:

1. This Act may be cited as the Passenger Facility Charge Short title.
(Amendment) Act, 2003.

2. The Passenger Facility Charge Act, 2002, in this Act re- Amendment of
ferred to as "the principal Act", is amended in section 2 by the section 2
addition of the following definition: Act No. 21 of

2002.

"weekly" means within the period of seven days commenc-
ing on a Monday and ending on the Sunday of that period.

3. Section 4 of the principal Act is amended - Amendment of
section 4.

(a) by the deletion of paragraph (a) and the substitu-
tion of the following:

The Passenger Facility Charge No. 13 of 2003.
(Amendment) Act, 2003.

"(a) passenger transiting Antigua and. Barbuda,
whether or not on the same flight, if the pe-
riod of transit does not exceed twenty-four
hours;"

(b) by the insertion of the following paragraph irnme-
diately after paragraph (h):

"(i) passenger departing from, and returning to,
Antigua and Barbuda on the same date;" and

(c) by re-lettering paragraph (9 as paragraph 0).

4. Section 10 of the principal Act is amended in subsection
(3) by the deletion of the words "no later than seven (7) days"
and the substitution of the words "not later than fourteen days".

5. The principal Act is amended by the repeal of section 11
and the substitution of the following section:

"Time when 11. Every operating carrier shall remit all
remittance of
charge is due. nioneys collected as passenger facility charges

to the Comptroller within thirty days from the
date on which a report under subsection (3)
of section 10 is due".

6. Section 13 of the principal Act is amended by the deletion
from paragraph (a) of subsection (3) of the word "invoiced".

7. Section 14 of the principal Act is amended -

(a) in subsection (1) by the deletion of the words "in-
voice" and "a penalty of 2% of the passenger facil-
ity charge" and, in respect of the latter, the substi-
tution of the words "a penalty of 20% of the pas-
senger facility charge";

(b) by the deletion of subsection (2) and the substitu-
tion of the following:

(2) An air carrier that fails to make a re-
port within the period specified in subsection
(3) of section 10 is liable to pay a penalty of
One hundred ($100) US Dollars per month
or part thereof in respect of the report.
