No. 14 of 1994

AN ACT to amend the Marriage Act (Cap. 347).

[ 24th November, 1994. ]

ENACTED by the Parliament of Antigua and Barbuda as
follows -

1. This Act may be cited as the Marriage (Amendment) Act, short title.
1994.

2. The Marriage Act (Cap. 347) in this Act referred to as the Amendment of
principal Act is amended in sections 17 and 20 as follows - l 7 and 20s

(a) in section 17 (3) delete the words "twenty dollars"
and substitute the words "one hundred dollars";

(b) in section 20 (3) delete the words "twenty dollars"
and substitute the words "one hundred dollars".

3. Sectio113 1 of the principal Act is amended in subsection (2) Amendment of
by deleting the words "five dollars" and substituting the words se*ion31).
"twenty five dollars".

Amendment of 4. Section 36 of the principal Act is amended as follows-
section 36 (4).

(a) in subsection (2), by repealing paragraph (fI and
substituting the following-

"0 that in the case of an application for a
licence, oneof the parties was resident in
Antigua and Barbuda for a period of
fifteen days immediately preceding the
date of the application for a licence;

(g) that in the case of an application for a
special licence; both parties were present
in Antigua and Barbudaat the time of the
application."

(b) by renumbering paragraph (g) as paragraph (h);

(c) by repealing subsection (4) and substituting the
following-

"(4) The petition for a licence shall be accompanied by
a fee of one hundred dollars.

(5) The petition for a special licence shall be accompa-
nied by a fee of one hundred and fifty United States dollars
to be paid in the currency of the United States."

Amendment of 5. Sections 41 (1) and43 (2) of the principal Act are amended
41 and in subsectior~ (1) by deleting the words "five dollars" and substi-

tuting the words "twenty dollars".

Amendment of 6. Section 46 (a) of the principal Act is repealed and replaced
section 46. by the foH0wing -

"(a) Every Marriage shall be solemnized by some Mar-
riage Officer or celebrated by the Registrar-General
between the hours of six in the morning and eight in
the evening, and shall be solemnized or celebrated in
the presence of two or more credible witnesses
besides such Marriage Officer or Registrar General."

7. Section 54 of the principal Act is repealed and replaced by Amendment of
the following - section 54.

"(54) The following fees shall be pqable before the
performance of the duty to which the same respectively
relate -

(a) for every general search not d i i t e d
to any particular entry $25.00

(b) for every search for parlicular entry $20.00

(c) for every issuing copy and entry $25.00

(d) for every issuing of any certificate or
making any record of any fact not
otherwise provided for $25.00

(e) for correction of each error or omis-
sion $10.00

8. Section 65 of the principal Act is amended by renumbering Renumbering of
section 65 as subsection (1) and by adding the following - sect1011 65.

"(2) No marriage purported to be solemnized under this
Act during the period 1988 - 1993 by -

(a) the Reverend Dr. Lionel C. Richards of the
Anglican Church shall be, or deemed to have
been invalid by reason only that such marriage
was solemnized without the grant of a licence
or the publication of banns or that the licence
was defective;

(b) any Minister shall be or deemed to have been
invalid by reason only that such marriage was
solemnized at,a place other than a licensed
place."

9. The principal Act is amended by the insertion after ~€!Ction section 66 added.
65 of the following -

"Regulation 66. (1) The Minister responsible for legal
affairs may make regulations for the better
carrying out of the provisions of this Act.

(2) The Minister may in particular make
regulations -

(a) for prescribing the procedure for
submitting applications for li-
cences under this Act;

(b) for altering, rescinding or revising
the fees prescribed by this Act;

(c) for amending, prescribing or re-
vising the fonns in the Sched-
ules."
