(AMENDMENT) ACT, 2011

AN ACT to amend the Corporate Management and Trust Service Providers Act, 2008 No. 20 of 2008
and for incidental and connected purposes.
ENACTED by the Parliament of Antigua and Barbuda as follows:
1. Short title
This Act may be cited as the Corporate Management and Trust Service Providers (Amendment) Act,
2011.
2. Interpretation
In this Act “the principal Act” means the Corporate Management and Trust Service Providers Act,
2008 No. 20 of 2008.
3. Amendment of section 5
The principal Act is amended in section 5(3) by repealing the words “Schedule J” and substituting the
words “the Regulations”.
4. Amendment of section 6
The principal Act is amended in section 6 by repealing—

(a) in subsection 4(a) the words “Schedule A, or in such other forms as may be prescribed”
and substituting the words “the Prescribed Forms in the Regulations”;
(b) in subsection 4(b) the words “Schedule B” and substituting the words “in the Prescribed
Forms in the Regulations”;
(c) in subsection 4(b) the words “Schedule C” and substituting the words “in the Prescribed
Forms in the Regulations”; and
(d) in subsection 4 (c) the words “Schedule I” and substituting the words “in the Prescribed
Forms in the Regulations”.
5. Amendment of section 6A
The principal Act is amended in section 6A by—
(a) inserting in subsection 2(a) after the word “prescribed” the words “in the Regulations”;
(b) inserting in subsection 2(b) after the word “prescribed” the words “in the Regulations”;
and
(c) repealing in subsection 2(c) the words “prescribed in Schedule I” and substituting the
words “in the Prescribed Forms in the Regulations”.
6. Amendment of section 9
The principal Act is amended in section 9 by repealing—
(a) in subsection 2(a) the words “Schedule E” and substituting the words “in the Prescribed
Forms in the Regulations”; and
(b) in subsection 2(b) the words “Schedule EI” and substituting the words “in the Prescribed
Forms in the Regulations”.
7. Amendment of section 22
The principal Act is amended in section 22 by repealing—
(a) in subsection (1) the words “on the form prescribed in Schedule H”; and
(b) in subsection (2) the word “Administrator” and substituting the words “Director of the
Office of National Drug and Control Policy”.
8. Amendment of section 25
The principal Act is amended in section 25 by
(a) inserting after subsection (2) (d) the following—
“ (e) prescribing the forms and schedules to be used in connection with the provisions of
this Act;
(f) prescribing the appropriate application and licence fees;
(g) adding any forms or schedules to the regulations;
(h) prescribing guidelines governing the business of corporate and trust service
providers;
(i) prescribing guidelines for the eff ctive implementation of this Act; and
(j) prescribing administrative penalties for failure to file returns on time, statements
and other documents required to be filed under this Act or the directions of the
Commission.” and
(b) by repealing subsection (3).
