CHAPTER 46

THE BEACH PROTECTION ACT

BEACH PROTECTION

(18th June, 1957.)

1. This Act may be cited as the Beach Protection Act. Short title.

2. In this Act- Interpretation.

"authorized officer" means any police officer or other
person duly appointed as such by the Director of
Public Works by a notification published in the
Gazette and in one or more newspapers circulating
in Antigua and Barbuda;

" building or construction purposes" includes the erec-
ting and improving of, and the adding to, and the
repairing of buildings, and the constructing or
repairing of any road;

"Director of Public Works" means the person for the
time being performing the duties of Director of
Public Works of Antigua and Barbuda.

3. The Director of Public Works may, from time to
officers. time, appoint authorized officers for and in respect of any

parish in Antigua and Barbuda for the purpose of issuing
permits under section 4.

Removal of sand* 4. (1) It shall not be lawful for any person to-

any public road, except under and in accordance with
a written permit from the Director of Public Works or
an authorized officer and subject to such terms and con-
ditions as are therein stipulated.

(2) Every such permit shall be in the form in the
Schedule. Schedule and shall only hold good for the period therein men-

tioned, such period not to exceed one month.

(3) The granting of a permit under this Act shall be
in the discretion of the Director of Public Works or an
authorized officer, but no such permit shall be granted to
any person for any purpose other than building or construc-
tion purposes or for the purpose of providing ballast for
vessels.

(4) Any person who contravenes the provisions of
subsection (1) shall be liable to a fine not exceeding five hun-
dred dollars or to imprisonment for a term not exceeding
three months.

dollars or to imprisonment for a term not exceeding three

be recovered in a summary manner before a Magistrate on
complaint of any person and one-half thereof shall be paid
to the person who shall have given information leading to
the conviction of the offender and the other half shall be paid
into the Treasury to the credit of the general revenue.
