CIRCULAR Of the General Department of statistics, Ministry of planning and investment, no. 01-LB 31 March 1997 on the guidelines for the statistical work of enterprises with foreign direct investment and foreign parties involved in business cooperation contracts _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ pursuant to the law on foreign investment in Vietnam on November 12, 1996;
Based accounting and Statistics Ordinance on May 10, 1988;
Pursuant to Decree No. 12/CP dated 18 February 1997 detailing the implementation of the law on foreign investment in Vietnam;
General Design Bureau and the Ministry of planning and investment guidelines for the statistical work of enterprises with foreign direct investment and foreign Parties involved in business cooperation contracts as follows: i. for IMPLEMENTATION of all FUTURE business venture, the 100% foreign-owned enterprise (hereinafter referred to as "enterprise with foreign direct investment") and foreign Parties involved in business cooperation contracts under the law on foreign investment in Vietnam made regulations on work by the design Bureau Of statistics and the Ministry of planning and investment issued, or by the ministries and people's committees of the province, the city of centrally issued when the consent in writing of the total design Bureau and the Ministry of planning and investment.
For business partnership contract has many foreign Parties involved, the Party unanimously nominated a foreign Party making the representation statistics, other parties have the responsibility to provide figures for the party making the representation.
II. CONTENT of the STATISTICAL WORK of periodic statistical reports and statistical investigation (referred to as statistical reports) applicable to enterprises with foreign direct investment and foreign Parties involved in business cooperation contracts made in nationwide about :-on form submit, the agency receiving the report;
-The method of calculating the norms, unit;
-States the report.
Statistics by enterprise with foreign direct investment and foreign Parties to the contract business report is a valuable document to assess the results of production, business, perform the duties of the unit in accordance with the investment license. Statistical reports must establish full, calculated in accordance with the criteria of content, methods and regulations filed on time.
III. REPORTING PERIODIC STATISTICS: statistical report mode periodically apply for businesses that have foreign direct investment and foreign Parties involved in business cooperation contract attached to this circular are effective from April 1, 1997 instead of the statistical reporting regime issued decision No. 131/QD-LB on 30 November 1993 of the General Design Bureau-the State Committee for cooperation and investment and the statistical report form in Appendix No. 7 attached to circular No. 215/UB-LXT 8 February 1995 of the State Committee for cooperation and investment.
1. Types of reports and the time of submission of the report: the report form system consists of:-A/01 number of FOREIGN Expressions: reports, apply for, 1, 2, 3, 4, 5, 7, 8, 9, 10, 11; on 10 December after the report submission-1 B/FOREIGN and 1 or a number from 10 to 2 A/FOREIGN/FOREIGN-G (depending on the specialized nature of each project): report of the first 6 months; report all year. Time of filing reports first 6: on July 15; all five: on 10 February the following year.
Particularly for the 1996 report, the business for foreign direct investment and foreign Parties involved in business cooperation contracts unification follow reports in the form specified in this circular, filed a report on April 30, 1997.
Data recorded in the report in the official results reflected the production, business in the year of the business. In the case of data reported in the other figures recorded in the audited year settlement confirmed the Agency received reports will automatically adjust data again according to the audit results.
2. The agency receiving the report: all businesses with foreign direct investment and foreign Parties involved in business cooperation contracts submitted the report to the Ministry of planning and investment, the design Bureau and the Department of planning and investment, the central city where the unit is headquartered. Private exporters report, direct import (02D/FOREIGN) must submit to the Ministry of Commerce.
This circular regulates the business for foreign direct investment and foreign Parties involved in business cooperation contracts reported statistics for the State Agency. The parent corporation or company in the country or overseas report business requirements is the internal relations of production, business is not in the scope of the provisions of this circular.
IV. EXAMINE and HANDLE BREACH of The Service function of the design Bureau and the Ministry of planning and investment, the Director of the Department of planning and investment, the provincial Statistics Bureau Chief, central cities and popular track, test implementation of this circular.
Six months, the Director of the Department of planning and investment, the same Director of the Bureau of statistics, the city notified in writing to the business for foreign direct investment and foreign Parties involved in business cooperation contract on the city in the province, said the implementation of statistical report mode (about the time limit , data quality, ...), at the same time sent the Ministry of planning and investment and the General Department of statistics to the report.
The Agency performs the functions check, if the violation is processed promptly under the authority. Violations exceeded the authority shall report on the levels of administration.
