CIRCULAR On the amendments, additional circular No. 09/TT-LT on 29/01/1997 of the Ministry of public security and the Ministry of Foreign Affairs guidelines decision No. 875/TTg dated November 21, 1996 by the Prime Minister On 29 January 1997, the Ministry of Interior (now the Ministry of public security) and the State Department issued Circular No. 09/TT-LT instructions make Recipes No. 875/TTg dated November 21, 1996 by the Prime Minister about the resolution for Vietnam citizens residing abroad returned Vietnam.
 
To create more favorable conditions for refugee repatriation, the Ministry of public security and the Ministry of Foreign Affairs revised uniform, some additional content in circular No. 09/TT-LT is as follows: 1. Modify, Supplement 1 in section I: "1. Vietnam nationality conditions (outlined in paragraph 1 article 2 of decision No. 875/TTg) consists of the following two cases :-Bring a passport or papers instead of Vietnam Vietnam passport be valid due to immigration management Bureau Ministry of public security or Vietnam's representative offices abroad;
-If no passport or papers instead of Vietnam passport be valid, it must have one of the following papers: + certificate of registration of citizens due to Vietnam's representative offices abroad;
+ Vietnam citizenship certificates by the PPC, city in Central or Vietnam's representative offices abroad ".
2. additional amendments in section II point 2: "2. passport copy, the proof of citizenship and proof of Vietnam are foreign to the settlement, as papers that allow indefinite residence or permanent residence or permanent residence (hereinafter referred to as the settlement papers) :-for repatriation applicants carry passports or travel documents valid Vietnam passport replacement: + snapshot of passport or passport replacement documents;
+ Snapshot papers settled by the competent bodies of foreign countries.
-For repatriation applicants bring their passport or foreign passport replacement documents also value: + snapshot of passport or passport replacement documents;
+ Paper Copy citizen registration confirmation due to Vietnam's representative offices abroad or certificate of nationality Vietnam due to PPC, city in Central or Vietnam's representative offices abroad.
-For repatriation applicants had no passport or papers instead of the passport of Vietnam or oversea as stated above: + snapshot papers settled by the competent bodies of foreign countries;
+ Paper Copy citizen registration confirmation due to Vietnam's representative offices abroad or certificate of nationality Vietnam due to PPC, city in Central or Vietnam's representative offices abroad.
Snapshot of the settlement papers are due to Vietnam's representative offices abroad to confirm as defined in point 4 of this circular; copy of passport or papers instead of passports, citizenship registration certificate, a certificate of nationality to Vietnam by the competent authorities of Vietnam notarized or attested. The case of the direct repatriation applicants filing in Vietnam's representative offices abroad or immigration agency under the Ministry of public security shall not require the filing of a copy, attested, that receiver responsibility required a key to compare with snapshot collation officer, have to write to the snapshot of that "Comparing with original" and sign, stating the full name, the date for screening ".
3. Amendments and supplements section III: "1. Refugee repatriation are abroad, when the notice of Vietnam's representative offices abroad on the permitted repatriation, within 12 months from the date of the notice of right to the representative body to get Passport return If too new/12 to get your pass to repatriation procedures as follows: a) the case too time but yet too, 24 February to submit declarations suggest received the Passport return (form HH4 attached) and 2 new photo shoot.
b) case too the time limit of 24 months or more, must redo application for repatriation as the first procedure specified in section II of circular No. 09/TT-LT on October 29, 1997 and point 2 of this circular.

4. Modify, Supplement 1 and 2 in section IV: "1. for Vietnam's representative offices abroad:-in addition to the responsibilities outlined in point 1 article 5 decision No. 875/TTg, representative bodies of registration certificate, a certificate of nationality, Vietnam confirmed the authenticity of the proof to be abroad for settlement under the guidance of the Ministry of Diplomacy.
-Notification in writing to the refugee repatriation know results solve application for repatriation within 10 working days from the date of receiving the written notice of the Ministry of public security. the approved case for repatriation, then in written notice of representative body should specify the time limit allowed to repatriate must to get Passport return (within the time limit 12 months from the date the Agency represented has written notice).
-When levels pass repatriation must complete, specific columns, items, including: the "permanent address" must specify the house number, street name, town/Ward, district, district, province/city; photo collage in passport repatriation must be marked with borders and take measures of protection as prescribed for the image when the Passport.
2. for the Ministry of public security (Immigration Administration):-notification results solve application for repatriation to Vietnam's representative offices abroad (via Fax), Ministry of Foreign Affairs, Public Security Department, the central cities in the period of 60 days from the date of receipt of a valid application for cases applying for repatriation in the representative body of Vietnam abroad. With filing case in the country, in addition to the aforementioned bodies should inform relatives (guarantor) or notify the repatriation. Particularly for cases to redo the procedure because the message text are allowed to repatriate or return your pass expiry of 24 months, not too the announced results solve application for repatriation was made during 30 days from the date of receiving the winch (HH4 form) and 2 new photo shoot.
-The review process to resolve, even after Vietnam citizens residing abroad were repatriated, if people ask for repatriation or personal, relevant organizations have deceptive behavior to be granted permission to return home, the Ministry of public security has the responsibility to verify, as the nature and degree of the violation for which the handling or transfer agency processing functions under the law of Vietnam ".
5. This circular takes effect after 15 days from the date The report. The previous instructions by the Ministry of public security and the Ministry of Foreign Affairs contrary to this circular are repealed.
