Minister of science and technology and the Ministry of the Interior guidance functions, tasks, powers and organization of specialized agencies to help the people's Committee of the governance of science and technology in the locality as follows: i. SCIENCE and TECHNOLOGY 1. The position and function of the Department of science and technology is the professional body in the province people's Committee, the central cities (hereinafter referred to as the Department) help people's committees implement state management functions of science and technology, develop the potential of science and technology on all socio-economic sectors; standards and product quality; intellectual property (not including the copyrights on literature, art and trademarks); the radiation and nuclear safety in the province under the rule of law.

d) managed the operations assessment, appraisal, assessment, consultation and technology transfer in the province under the rule of law; appraisal, assessment of the technology for the project in the following hierarchy; track, aggregate and guide the technology assessment of economic institutions in the province; the Organization reviews the level of technology of the province;
DD) certificate of registration and inspection science and technology research and development organization, the Organization of scientific and technological services in the economic sectors in the province under the rule of law;
e) The provincial people's Committee issued the policy mechanisms to encourage organizations and individuals in and outside the wide application of the achievements of science and technology and local decision support for organizations and individuals in the use of technology, new techniques in production and life;
g) in collaboration with the Department of finance – pricing, planning and construction and the people's Committee of the annual budget estimates for the field of science and technology of the province and the district, the County, towns and cities in the suit the situation of socio-economic development and particularity of scientific and technological activity of the locality according to the regulations law and the instructions of the competent authorities; the decision established and regulated fund management mechanism of development of science and technology of the province under the rule of law;

h) in collaboration with the departments of industry, the building and the provincial people's Committee approved the program, planning, policy, development planning, management and effective use of scientific and technological potential of the province, including: encourage, attract personnel of science and technology; training of officers for the scientific and technological personnel; constructed, organizational activity of the laboratory according to the functions of the Department; investment in facilities and equipment for science and technology; information science and technology;
I) The President of the provincial people's Committee established the Advisory Board under the provisions of the law on Science and technology; perform the task the permanent organs of the Council of science and technology in the province.
2.5. Regarding standards and product quality a) guide the application of the standard of Vietnam, industry standards, foreign standards, international standards, and the standards required to apply at the request of State management for organizations, business personal, service on the province. b) directs, checking and reporting organizations, statistics, periodic reports of radioactive sources, radiation devices, radioactive waste and radiation activities locally in accordance with the law;

2.9. The inspection, check the enforcement of the law, to resolve the dispute, complaint, report and handle the breaking the law on Science and technology, standards and product quality, intellectual property, nuclear and radiation safety as stipulated by the law.
2.10. implementation of international cooperation in the field of the management of the Department in accordance with the law;
2.11. the science and technology statistics of the province according to the regulations of the Ministry of science and technology of 2.12. Help people's Committee Chairman state management the activities of the society and non-governmental organizations in the field of the management of the Department in accordance with the law;
2.13. Perform periodic reports 6 and irregular reports on the State of management and science and technology activities with the Chairman of the provincial people's Committee and the Minister of science and technology;

3. Organizational structure and staffing 3.1. Head of the Department of science and technology has the directors and not more than 3 Associate Director. The Director is the head of Department, responsible to the provincial people's Committee about the activities of the Department. The Deputy Director is the person who helps the Director in charge of one or some of the work and be responsible for the tasks assigned.
The appointment, dismissal, resignation of Director and Deputy Director by the Chairman of the provincial people's Committee decision according to the standard, the title and the process of party and State rules.

3.2. The institutions help the Director include:-Office;
-The inspection;
-Bureau of standards metrology and quality;
-The professional room service.

Based on the volume of work and the nature and characteristics of the scientific work and the particular local technology, Director of the Department of science and technology, coordinated with the head of the Organizing Committee the provincial government the province people's Committee decided the professional room service, but no more than 9 rooms. For the central cities not too professional, Room 5.
3.3. The unit:-Information Center and information science-technology;
-The Center for the application of scientific and technological progress;
-The other business units.
Chairman of the provincial people's Committee decided to set up the unit in other career Department under the provisions of the law.
Director of the Department of science and technology detailed rules, duties, functions and powers of the subdivisions.

1.4. In collaboration with the organizations, professional bodies the organization performs the service of science and technology to serve the needs of development of production and improve the lives of the people in the district;
1.5. standard task management, measurement, quality as prescribed by the laws and guidelines of the Department of science and technology;
1.6. The Chairman of the district people's Committee established the Advisory Council and the guidelines of the Department of science and technology; the Permanent Mission of the Council of science and technology the arrondissement;
1.7. Execution statistics, information science and technology under the guidance of the Department of science and technology;
1.8. In collaboration with scientific inspection and inspection technology for organizations and individuals in the implementation of policy, the law on Science and technology, standards and product quality, intellectual property, nuclear and radiation safety in the district;

2. III. ENFORCEMENT of the PROVISIONS of this circular replaces circular No. 05/TTLT-BVHTT on TCCBCP 7 March 2002 of the Ministry of science, technology and environment (now Ministry of science and technology) and the Organizing Committee-officers of Government (now the Ministry of the Interior) and have effect after 15 days from the Post Gazette.
Chairman of the provincial people's Committee pursuant to this circular specifies functions, tasks, powers and organization, staffing of the Department of science and technology and of the Agency for science and technology management at district level.
