CIRCULAR guide on medical practice, pharmacy by Health Ministry issued Ordinance base medical practice, a private pharmacy number 07/2003/PL-UBTVQH11-02/25, 2003;
Pursuant to Decree No. 104/2003/ND-CP on November 12, 2003 detailing the implementation of a number of articles of the Ordinance on medical practice, pharmacy private;
The Department of health guidance on medical practice, a private pharmacy as follows: chapter I GENERAL PROVISIONS article 1. Personal, domestic and individual organizations, foreign organizations are eligible under the provisions of the Ordinance on medical practice, pharmacy, Decree No. 104/2003/ND-CP on November 12, 2003 detailing the implementation of a number of articles of the Ordinance on medical practice, pharmacy investors (hereinafter referred to as the Decree No. 104/2003/ND-CP) and of this circular are medical practice , the private pharmacy.
Article 2.
1. The certificate of medical practice, the private pharmacy is writing by the Ministry of health or the Department of health, the central cities (hereinafter referred to as the Department of health) grants for individuals are eligible under the provisions of the Ordinance on medical practice, pharmacy, Decree No. 104/2003/ND-CP and of this circular to registered medical practice , the private pharmacy.
2. The certificate of qualified medical practitioners, the private pharmacy is written by the Ministry of health or the Department of health give the basis of conditions under the provisions of the Ordinance on medical practice, pharmacy, Decree No. 104/2003/ND-CP and of this circular.
Article 3.
Certificate in medical practice, the private pharmacy has the following categories: 1. The certificate of medical practice: a) professional examination and treatment;
b) practice of medical services;
2. The certificate of practice traditional medicine: a) professional examination and treatment using traditional medicine;
b) practice medicine traditional medicine;
3. the practice of Pharmacy;
4. The certificate of practice of medical products, vaccines.
Article 4.
1. The certificate of medical practice, the private pharmacy provided only for individuals, not for the organization. Each individual is only being granted a certificate of practice to make the head or Manager of a professional organization forms of practice.
2. The certificate of qualified medical practitioners, the private pharmacy provided only for practice, not for individuals. The basis of medical practice, only private pharmaceutical practice under the professional range and at the location specified in the certificate of eligibility to practice.
Article 5.
1. practising certificates, certificates of qualified medical practice, private medicine worth 5 years from the date of issue. Before the expiration of 3 months, if you want to continue the practice of the individual, the organisation must do the procedure suggested the extension of State administration in the health authority has granted.
2. The certificate of medical practice, the private pharmacy is granted regardless of where the registered permanent residence of the person who proposed the certificate.
3. for Hanoi, Ho Chi Minh City, Haiphong and Da Nang: a) Who have permanent residence in Hanoi, Ho Chi Minh City, Haiphong and Danang are certified medical practice, a private pharmacy for one of all the forms of organization of medical practice, the private pharmacy if enough conditions under the provisions of the Ordinance on medical practice , the private pharmacy, Decree No. 104/2003/ND-CP and of this circular;
b) who do not have permanent residence in Hanoi, Ho Chi Minh City, Haiphong and Danang if qualified under the provisions of the Ordinance on medical practice, pharmacy, Decree No. 104/2003/ND-CP and of this circular was issued a certificate of medical practice, the private pharmacy for one of the forms of organization of medical practice the private pharmacy, here at the local on:-hospital;
-Business Pharmaceuticals, vaccines, biological medical products;
-Drug testing facility;
-Storage facility;
-Vaccine testing facility, medical products;
-Preservation of vaccines, medical products;
-The basis of medical practice, private pharmacy foreign capital.
c) depending on the needs, capacity management, Chairman of the city people's Committee of Hanoi, Ho Chi Minh City, Da Nang, Hai Phong city could enable the Health Department review and certification of medical practice, private medicine for people who do not have permanent residence in the locality that for one of the forms of other organizations in addition to the forms of organized the medical profession, the private pharmacy specified in point b of paragraph 3 of this Article.
4. Individuals, organizations to recommend certification of medical practice, pharmacy, certificate of qualified medical practice, a private pharmacy to pay the fees and charges prescribed by the law.
Article 6.
The medical practice of private medicine, exercise their rights and obligations under the provisions of articles 18, 23, 28, 32, 36 of the Ordinance on medical practice, pharmacy and is responsible for the correct implementation of the regulation on medical expertise, pharmacy. In the course of practice, practitioners must keep learning advanced professional level, to master the rules of the industry, the law of the State.
Every year the Ministry of health in collaboration with the Medical Association, Pharmacology Pharmacology Society, Vietnam Vietnam, the Vietnam Association of Oriental medicine, the Department of health in collaboration with the Medical Association, the society for pharmacology, Oriental Medicine Association of province level to organize advanced training qualification, popular updated legal texts on health. The Ministry of health, the Department of health is responsible for the organisation of professional activities, professional training at the same time create conditions conducive to the practice of private medicine, medical training, retraining as stipulated by law. Training, training funds due the basis of medical practice, the private Pharmacy School candidate who is responsible to pay.
Article 7.
1. The basis of medical practice, a private pharmacy to have enough people to do professional work consistent with the scope of practice. Who do the work expertise in the practice of private medicine, medicine as prescribed in this circular are: a) has the qualifications, certificates of qualification match assignments;
b) Have the capacity for civil acts in full;
c) Have full health certificate to work due to the treatment facility district or higher level;
d) Have labor contracts under the provisions of the law on labour;
DD) are not prohibited during practice or forbidden to do work related to health according to the decision of the Court; not being prejudice criminal liability or are being applied to administrative probation measures; not being in time trial or jail Executive decided to apply administrative measures taken on the basis of education, curative establishments or administrative probation; not being in time observance of the discipline of medical expertise.
2. Foreigners who do the work expertise in the medical facility, the private traditional medicine are the Ministry of health to license if it satisfies the provisions of paragraph 1 of this article and the following conditions: a) Having legally qualified by country level. Particularly for direct examination and treatment must be by a graduate of the medical professions;
b) Have legal practice certificate or certificate has been practicing on 3 years due to the country level;
c) with regard to direct alien doctor, cure for sick people must know the South Vietnamese or must have an interpreter. The medication required to write by Vietnamese and foreign language examinations, prescription directly;
d) has a criminal record are the competent authorities of the country;
DD) Have work permit by the State Management Agency about labor of Vietnam;
e) labor contract according to the provisions of the law on labour;
3. Translator specified in point b of paragraph 2 of this Article must have the following conditions: a) have graduated from medical school, professional pharmaceutical professional, professional high school of traditional medicine or medical salary;
b) have graduated University foreign language consistent with the language of the

4. If the private medical practice facility, private traditional medicine and there have been no translator to meet the conditions prescribed in point b of paragraph 3 of this Article, the head of the facility that is permitted to use the foreign language certificate translated in C above until 31/12/2007. The head of the facility to be responsible about the professionalism of the translator.
5. When the changes do work expertise, the basis of medical practice, the private pharmacy must report to the competent bodies the certification to know. In case of change of the overseas professional work or change the interpreter, the basis of medical practice, the private pharmacy must do the procedures required under the regulations to report to the competent authority that has granted the certificate of qualified medical practice, a private pharmacy to review and licensing.
6. The case of the head or the Manager of the professional basis of medical practice, pharmacy direct cannot be privately operated the facility for reasons of sickness, vacation, going to school or because of other reasons: a) if time cannot be directly operated the facility under 3 days the authorization must be written for people who are eligible under the provisions of chapter II of This investment alternative;
b) if time cannot be directly operated the base on 3 August, the authorization must be written for people who are eligible under the provisions of chapter II of this circular replaces and report in writing to the local health department.
c) if time cannot be directly operating the base from 30 days to 180 days, must be authorized in writing to another person, report in writing the Department of health and the Department of Health approved in writing.
d) if time cannot be directly run on the basis of the 180 days, the basis of medical practice, a private pharmacy to do for practising certificate for the head or the professional manager instead.
DD) depending on the requirements of each organization forms of practice, a person authorized under regulations replace the work of the points a, b, c, d paragraph 6 this must have sufficient conditions as defined in chapter II of this circular;
e) encouraged the basis of medical practice, the private pharmacy has two certificate of medical practice, a private pharmacy to replace when needed. Case basis has two certificate of medical practice, a private pharmacy, when the certificate of practice is the head or the professional manager is away, you can authorize other people practising certificate and report in writing to the local health department said.
7. Who do the work expertise in the medical facility, the private pharmacy must wear the signs (signage content as specified in annex 6).
Article 8. The basis of medical practice, the private pharmacy is responsible for the correct implementation of the provisions of the law on advertising.
CHAPTER II medical practice of PRIVATE MEDICINE, article 9. Officers, public officials, who are working in the medical facility, the State's only pharmaceutical grade medical practice, a private pharmacy to do the head of one of the forms of organization of practice individual business households registered as follows: 1. the specialist clinics; the base medical services excluding basis of patient transport services in the country and abroad to the provisions in clause 5 article 16 of Ordinance on medical practice, pharmacy private;
2. traditional medicine; the basis of treatment services, nursing, rehabilitation by the method of acupuncture, massage therapy, nursing, relieves gas, steam, public smoking of traditional medicine; business establishments, smoking traditional medicine except the type of drug product manufacture traditional medicine;
3. Pharmacy, medication sales agent for drug business;
4. sale agent vaccine, medical products for the business of vaccine, medical products.
A PRIVATE medical practice CERTIFICATE article 10. The organizational form of private medical practice includes: 1. General Hospital, specialty hospital;
2. Clinic;
3. Specialty Clinic: a) General internal clinics, specialty clinics in the inner system;
b) family clinic, medical consulting rooms;
c) specialty clinics;
d) specialty maternity clinic, family planning;
specialist dental clinic)-jaw-facial;
e) specialty clinics;
g) specialty clinic ear-nose-throat;
h) specialty clinic cosmetic surgery;
I) specialty clinic nursing, rehabilitation and physical therapy;
k) specialty clinic diagnostic imaging;
l) laboratory: Biochemistry, hematology, microbiology, Anatomy, microscopic disease;
4. Home midwifery;
5. medical service facilities: a) service establishments do dentures;
b) injectable facility (sting), instead of tape, counting circuits, temperature measurement, measuring blood pressure;
c) basis of health care services in the home;
d glass services facility medication);
6. The basis of patient transport services in the country and abroad.
7. The forms of other medical services.
I. PROFESSIONAL treatment article 11. General conditions: People are practising certificate examination and treatment must have the following conditions: 1. There is one of the following qualifications depending on the requirements of each organization forms of practice and professional scope of practice: a) medical university diploma;
b) graduate medical college;
c) using the graduated from high school the medical professional;
d) pharmaceutical university diploma;
DD) By specialized college graduates about biology, chemistry;
2. was there a time in the practice of pharmacy, medical facility match the requirements of each organization forms of practice. The grounds for determining the time practice was defined as follows: a) for officials and civil servants, who are working in the medical facility, pharmacy of the State but have retired or resigned, the time base is the work of a legitimate star decided to retire or decide to resign the attached paper, confirmed the practice of the heads of units where people suggest practising certificate has practiced or endorsed by the heads of the Unit decided to resign or retire;
b) for people who work in the medical facility, a private pharmacy, the time base is working in real time confirmation of the head of the facility, accompanied by a copy of the legal labor contracts;
c) for officials and civil servants, who are working in the medical facility, the State's pharmacy based working time in confirmation of the heads agreed to allow private medicine, medical practice outside of the work of the State. Certificate must specify the time practice at the medical facility, the State's pharmacy.
3. professional ethics; not subject to the provisions of article 6 of the Ordinance on medical practice, pharmacy private;
4. Has the paper confirmed healthy enough to work by base treatment district level upwards;
5. is there a written commitment to understand and implement the law on protection of people's health, the Ordinance on medical practice, medicine, national health programmes, the rules regarding medical and technical expertise in the legal text of the related medical (according to Appendix 1).
Article 12. Specific conditions: The proposed certification practice examination and treatment to ensure the General conditions as defined in article 11 of this circular and the following specific conditions: 1. The head of the hospital, the clinic must be the doctor has practiced 5 years at the base hospital , healing;
2. for the head of the Organization Forms of practice but the Organization Forms of practice under the provisions of this paragraph 1: a): family clinic doctor or specialist doctor has practiced family medicine for 5 years at the base hospital, healing in that 3 years practicing family medicine specialist.

b) internal general clinics, specialist clinics in the inner system, foreign exchange specialist clinics, maternity-family planning rooms, eye, ENT, Maxillofacial, dental nursing-rehabilitation and physical therapy, cosmetic surgery: doctors have practiced 5 years at the base hospital, healing , out of which 3 years of professional practice.
c) imaging: Radiology, physician (University graduates) have practiced 5 years specialist diagnostic imaging in medical establishments, healing.
d) laboratory: your doctor or pharmacist, Bachelor in biology, chemistry, laboratory technician (University graduates) have a 5 year specialist practice tests at the base hospital, healing.
midwifery Home): midwives, doctors from the middle school has specialist practice 5 years at the base hospital, healing, of which at least 3 years professional practice gynaecology. To ensure the security of health for mothers and children, the head of midwifery Home must be 100% practitioners time (not the practice outside).
3. In the mountainous areas, Islands, the minorities, the region particularly hard, the proposed certification practice examination and treatment according to the requirements of each organization forms of practice prescribed in clause 2 of this could be your doctor, pharmacist, University, major in biology Chemistry, Bachelor, Radiology (University graduates) have 3 years or specialist practice doctors, nurses, technicians, midwives from the middle school has a 5 year specialist practice in medical establishments; the certificate of practice clinical practice is allowed only to the extent of that region.
 
II. PROFESSIONAL health SERVICES article 13.
1. In addition to the General conditions stipulated in paragraph 1, points a, b, c paragraph 2, paragraph 3, 4, 5 article 11 of this circular, who recommended professional level of medical services in the forms of organization of practice prescribed in clause 5 article 10 of this circular must have time to practice from 2 years upwards at the base hospital , healing and ensure the following specific conditions: a) for the head of the service base of injection (injecting), instead of tape, count, temperature, blood pressure is high school graduation health care professional;
b) for heads of grassroots health care services in the home to professional health high school graduation;
c) for the head of the facility made the dentures are dental practice has grown from 1980 and earlier must have the certificate of the local authorities.
d) for the head of the base glass smoking services must have one of the following qualifications:-high school diploma medical professional back-up and had time to do professional work at eye specialist from 2 years upwards;
-High school diploma medical professional and above and have a certificate for medical equipment (measuring equipment, diagnosis of refractive eye) due to the base was appointed Ministry of health training and grants;
DD) in the mountainous areas, Islands, the minorities, the region particularly hard, the proposed certificate of practice of medical service according to the requirements of each organization forms of practice specified in point a, b paragraph 1 of this article may be the doctor had practised from 1 year upwards or graduate medical college the professional school of medicine, has practiced from 2 years upwards at the base hospital, healing; the practising certificate are only allowed to practice within the scope of that region.
2. for the head of the facility the patient transport services in the country and abroad to ensure the General conditions specified in point a, b, c paragraph 2, paragraph 3, 4, 5 article 11 of this circular and graduated from the Medical University, has a 5-year practice in medical facility , healing, certified learned about specialization in emergency resuscitation.
CATEGORY B PRACTICE PRIVATE TRADITIONAL medicine article 14. Organization Forms of practice traditional medicine consisted of: 1. The Hospital of traditional medicine;
2. traditional medicine;
3. The basis of treatment services, nursing, rehabilitation by the method of acupuncture, massage therapy, nursing, relieves gas, steam, public smoking of traditional medicine;
4. Business establishments, smoking traditional medicine include:-production facilities, business smoking finished products of traditional medicine;
-Drug business base slab of traditional medicine;
-A medicinal business establishments not yet constructed;
-The vendor of the drug products of traditional medicine;
5. legacy Center, application of traditional medicine.
Article 15. General conditions: The proposed certificate of practice traditional medicine and must have the following conditions: 1. There is one of the following qualifications depending on the requirements of each organization forms of practice and professional scope of practice: a university or diploma of) Central professional learning about traditional medicine;
b) by a graduate professional school of pharmacy or pharmaceutical and pharmacological studies were certificates have traditional due to the basis function training was appointed Health Ministry training and grants;
c) degree of medical herbalists, wages due to the basis function training was appointed Health Ministry training and grants;
d) traditional post certificate by the Ministry of health;
DD) traditional post certificate by the Department of health has issued before the date of this circular in force;
e) a certificate of qualification by the traditional medicine Department of health or the Department of health has granted prior to the date of this circular in force;
2. The conditions as specified in paragraph 2, 3, 4 and 5 article 11 of this circular.
Article 16. Specific conditions: The proposed certification practice examination and treatment using traditional medicine to ensure the General conditions prescribed in article 15 of this circular and the following specific conditions: 1. for the proposed certification practice examination by traditional medicine : a) to head the Hospital of traditional medicine:-have graduated from the University of traditional medicine;
-Time practice from 5 years and over at the base hospital, healing with traditional medicine.
b) to head the Center for inherited traditional medicine:-one of the following certificates, qualifications: high school diploma + expertise in traditional medicine;
+ Certificate of traditional medical professional (certified medical salaries) by the Ministry of health or the Department of health has granted prior to the date of this circular in force;
+ Degree salaries by function basis medical training was appointed Ministry of health training and grants;
-Time practice from 5 years and over at the base hospital, healing with traditional medicine.
c) to head the room traditional medicine, treatment facilities, rehabilitation nursing, by method of acupuncture, massage, diet relieves, qigong, sauna and traditional medicine: drugs-has one of the following certificates, qualifications: high school diploma + expertise in traditional medicine;
+ Degree salaries by function basis medical training was appointed Ministry of health training and grants;
+ Certificate of traditional medical professional (certified medical salaries) by the Ministry of health or the Department of health has granted prior to the date of this circular in force;
+ Traditional post certificate by the Ministry of health;
+ Traditional post certificate by the Department of health has issued before the date of this circular in force;
-Time practice from 5 years and over at the base hospital, healing with traditional medicine.
2. The proposed certificate of practice medicine traditional medicine: a) To head of production facilities, business smoking finished products of traditional medicine business household registration personal:-one of the following certificates, qualifications: high school diploma + expertise in traditional medicine;

+ Diploma of professional secondary school of Pharmacy and pharmaceutical studies were certificates have traditional due to the basis function training was appointed Health Ministry training and grants;
+ Diploma of medical herbalists, wages due to the basis function training was appointed Health Ministry training and grants;
+ Certificate of professional qualification due to traditional medicine and the Department of health or the Department of health has granted prior to the date of this circular in force;
+ Traditional post certificate by the Ministry of health;
+ Traditional post certificate by the Department of health has issued before the date of this circular in force;
-Time practice from 2 years upwards in the manufacturing, trading and product of traditional medicine.
b) to head the business base of drug registration plates the individual business households:-one of the following certificates, qualifications: high school diploma + expertise in traditional medicine;
+ Diploma of professional secondary school of Pharmacy and pharmaceutical studies were certificates have traditional due to the basis function training was appointed Health Ministry training and grants;
+ Diploma of medical herbalists, wages due to the basis function training was appointed Health Ministry training and grants;
+ Certificate of professional qualification due to traditional medicine and the Department of health or the Department of health has granted prior to the date of this circular in force;
-Time practice from 2 years upwards in the traditional pharmaceutical facility.
c) to head business establishments not medicinal products (medicinal herbs) to register individual business households:-one of the following certificates, qualifications: high school diploma + expertise in traditional medicine;
+ Diploma of professional secondary school of Pharmacy and pharmaceutical studies were certificates have traditional due to the basis function training was appointed Health Ministry training and grants;
+ Diploma of medical herbalists, wages due to the basis function training was appointed Health Ministry training and grants;
+ Certificate of professional qualification due to traditional medicine and the Department of health or the Department of health has granted prior to the date of this circular in force;
-Time practice from 2 years upwards in the traditional pharmaceutical facility.
d) to head the drug agency finished product base of traditional medicine:-one of the following qualifications: + degree salary y, herbalists do Base training function was appointed Ministry of health training and grants;
+ Certificate of professional qualification due to traditional medicine and the Department of health or the Department of health has granted prior to the date of this circular in force;
-Time practice from 2 years upwards in the traditional pharmaceutical facility.
CATEGORY C CERTIFICATE of PRACTICE of PHARMACY article 17. Organizational form of private pharmacy practice include: 1. The business of drugs (medicine production, production of medicines from pharmaceutical, drug trafficking). The drug business has the unit depends of your business: Branch, shop, drugstore products (hereinafter collectively referred to as your business).
2. Drugstore.
3. sell the drug dealer for the drug business. 
4. storage facility.
5. drug testing facility.
Article 18. General conditions: The proposed pharmacy practice certificate must have the following conditions: 1. no objects defined in article 6 of the Ordinance on medical practice, pharmacy private;
2. One of the following qualifications depending on the requirements of each form of practice and professional scope of practice: a university diploma of pharmacy);
b) by professional high school of Pharmacy;
c) degree nurse.
3. The conditions prescribed in item 2, 3, 4 and 5 article 11 of this circular.
Article 19. Specific conditions: The proposed certificate of practice of Pharmacy must ensure the General conditions according to the provisions of article 18 of this circular and the following specific conditions: 1. The person has the university diploma of Pharmacy and has had time to work at the medical facility, from 5 years and over is suggested practising certificate to do the head or the Manager expertise for business or to do the head for one of the following types: a) pharmacies;
b) drug testing facility;
c) storage facility.
2. People who have a degree from a nurse and have at least 2 years of work at the medical facility, the proposed pharmacy practice pharmacy certificate to do the head vendor of drugs for drug business.
3. In the area of socio-economic conditions particularly hard, the social-economic conditions are difficult, the ethnic minorities: a) Who holds a university degree and have had time to practice at the medical facility, pharmacy or pharmacist, two years after graduating from University, specialized system overhaul is recommended practising certificate to do the the head or Manager of the business professional or the head of the Pharmacy;
b) Who are certified to practice pharmacy as defined in point a of paragraph 3 of this article are only allowed to practice within the scope of that region.
4. for the head of the pharmacy business: a) Who holds a university degree and have had time to work at the medical facility, medicine for at least 5 years;
In the region there are social-economic conditions particularly hard, the social-economic conditions are difficult, the ethnic minority, who have graduated from college and had the time to work at the medical facility, pharmacy for at least 2 years or the pharmacist College after graduation dedicated tu;
b) Who have a high school diploma of Pharmacy professional back-up and had the time to work at the medical facility, medicine for at least 2 years;
c) Who qualified nurse and have had time to work at the medical facility, medicine for at least 2 years.
            ITEM D PROFESSIONAL medical PRODUCTS, VACCINE article 20. Organization Forms of practice vaccine, private medical products include: 1. The business of vaccine, medical products;
2. sale agent vaccine, medical products for the business of vaccine, medical products;
3. Basis of vaccine testing, medical products;
4. The basis for preservation of vaccines, medical products.
Article 21. General conditions: The proposed certificate of practice vaccine, private health products must have the following conditions: 1. There is one of the following qualifications depending on the requirements of each organization and form professional range of practice: a) By pharmaceutical college graduates or high school of Pharmacy;
b) Graduate College of medicine or school of medicine;
c) specialized university diploma of biology;
2. The conditions as specified in paragraph 2, 3 and 4 of article 11 of this circular.
Article 22. Suggest practising certificate vaccines, private health products must ensure the General conditions prescribed in article 21 of this circular and the following specific conditions: 1. The head or Manager of the business expertise of vaccine, medical products or the head unit depends of your business : a) has one of the following qualifications:-University diploma of Pharmacy;
-Graduate College of medicine;
-University diploma specialisation in biology;
b) have time to practice from 5 years and over at the base medical products, vaccines, pharmaceutical establishments.
2. The head of the vendor of the vaccine, medical products for the business of vaccine, medical products: a) has one of the following qualifications: high school diploma-professional pharmacy;
-High school diploma medical professional;
-University diploma specialisation in biology;
b) have time to practice from 2 years upwards at the base medical products, vaccines, pharmaceutical establishments.
3. The head of the base tested vaccines, medical products, the basis for preservation of vaccines, medical products: a) has one of the following qualifications:-University diploma of Pharmacy;

-Graduate College of medicine;
-University diploma specialisation in biology;
b) have time to practice from 5 years and over at the base medical products, vaccines, pharmaceutical establishments.
CHAPTER III CONDITIONS and SCOPE of the PROFESSIONAL ACTIVITIES of the FOUNDATIONS of medical practice, A PRIVATE PHARMACY BASIS of PRIVATE medical practice to article 23.
1. Conditions of personnel, the facilities of the hospital: a) Director of the hospital must have the certificate of practice examination and treatment registered hospitals.                                                                                                                                      
b) Dean's therapist has a 5-year practice in the examination and treatment facility, including 3 years of professional practice. The conditions and the scope of practice of trading personal medical equipment, medical equipment dealer: a) conditions: – personnel: + The main responsibility of the technique must have one of the following qualifications: a university diploma of engineering systems; Graduate College of medicine, pharmacy;  Graduate of one of the secondary schools: medical engineering, pharmaceutical engineering school; Graduate of the school of engineering of the medical device;
+ High qualified cadres techniques in other disciplines must have certificates of specialized medical equipment due to the legal training of technical medical equipment or equivalent foreign certificate; the duration of this training course for at least a month + Have qualified technical personnel manual medical equipment business establishments;

Exclusively for the field of pharmaceuticals, medical equipment, health, encourage organizations, foreign individuals, Vietnam people settled abroad to invest in the production of medicines, medical equipment in Vietnam.
Article 62. Conditions for the Ministry of Health issued a certificate of eligibility to practice medicine, the private pharmacy for medicine, pharmacy, foreign investment: 1. Meet the needs of medical healing of people Vietnam, foreigners in Vietnam; meet the demand for drugs, vaccines, biological medical products, medical equipment of Vietnam;

Chapter V profiles, procedure, COMPETENT PRACTICE CERTIFICATION, CERTIFICATE of QUALIFIED medical practice, a PRIVATE PHARMACY Article 63.

-Photocopy of passport;
-There are 2 photo portrait size 4 cm x 6 cm. c) for foreigners, Vietnam people settled abroad (according to the law on foreign investment in Vietnam):-application practice certificate;
-A copy of qualified, licensed (if applicable), confirmation of time practicing on 5 years at the medical facility, of which at least 3 years of professional practice (if business registration according to the type of hospitals, specialty clinics) of the country where that person citizenship or where people live and work in the long term;
-Work permit by the Department of labour, invalids and social level for workers working on subtraction management in the case of a member of the Board, Director General, Deputy Director General, Director, Deputy Director of the enterprise;
-Automatic resume;
-Criminal are the competent authorities of the country;
-Health and confirm healthy enough to practice of examination and treatment establishments from the district;
-A commitment to implement the provisions of the law on protection of people's health, Ordinance on private medical practice, documents guiding the implementation of laws, ordinances and regulations of the relevant expertise;
-Photocopy of passport;
-There are 2 photo portrait size 4 cm x 6 cm. 2. Records suggest the extension of the certificate of practice: a) petition to renew the certificate of practice;
b certificate) healthy enough to practice by hospitals at district level upwards;

b) for grant proposals, renewal of practising certificates to register pharmaceuticals business pharmaceuticals business invested abroad: submit records about Vietnam drug administration-Ministry of health;
c) for grant proposals, renewal of the certificate of practice traditional medicine and to subscribe to the Hospital of traditional medicine, the basis of examination and treatment by traditional medicine have invested abroad: sending records about traditional medicine-Ministry of health;
d) for grant proposals, renewal of the certificate of practice of medical products, vaccines to registered business enterprise health products, vaccines have foreign capital: records of the Bureau of health and HIV/AIDS-Ministry of health;
2. The records suggest that the Director of the Department of health grant, renewal of the certificate of practice: posted on the Department of health where the grant proposal, renewal of the certificate of practice.

b) basis, traditional medicine, pharmaceuticals, vaccines, biological medical products, foreign investment in Vietnam.
The Ministry of Health established the Advisory Council with the participation of the medical society Of Pharmacology, Oriental Medicine Association of Vietnam Vietnam Vietnam Pharmacology Society, to review and process the Minister of health to grant or renew the certificate of medical practice, pharmacy.
2. The Director of the Department of health grant, renew the certificate of medical practice, traditional medicine, herbal medicine and vaccines, private health products for individuals to register the Organization Forms of practice of private medicine, except for the provisions in paragraph 1 of this article.
The Department of Health established the Advisory Council with the participation of the medicine, Oriental Medicine Association, the provincial Pharmacology for review and submission to the Director of the Department of health grant or renewal of a certificate of medical practice, pharmacy.
3. The certificate of practice issued by the Minister of health, renew the registration value of practice within the country.

g) for resellers for enterprise business, vendor of vaccines, medical products for enterprises producing vaccines, medical products must submit more legal copies of contracts between agents and the head of the agents.

b) where the Agency receives a profile if the profile request, the renewal of the certificate of eligibility of medical practice, the private pharmacy is not yet valid, then within 10 working days from the date of receiving the votes recorded on the record, the Agency receives the record must have the text message for the base-level proposals , the extension of the certificate of eligibility of medical practice, a private pharmacy to complement or complete records.
c) When getting the text additional requirements, base-level proposals, renewal of the certificate of eligibility of medical practice, a private pharmacy to true additional request and sent to the receiver. Article 69. The authority to grant, renew the certificate of qualified medical practitioners, the private pharmacy is regulated as follows: 1. The Minister of health to grant, renew the certificate of eligibility to practice for the following forms: a) hospitals;
b) drug producers, drug testing facility, the storage facility;
c) vaccine manufacturing business, medical products, vaccine testing facility, medical products, the basis for preservation of vaccines, medical products;
d) producers of medical equipment;
the medical facility), traditional medicine, pharmaceuticals, vaccines, biological medical products, medical equipment, the foreign investment.
The Ministry of Health established the Advisory Council with the participation of the Medical Association, Pharmacology Pharmacology Society, Vietnam Vietnam, the Vietnam Association of Oriental medicine, preventative medicine Vietnam Association for review and submission to the Minister of health to grant or renew the certificate of qualified medical practice , the private pharmacy.

2. The Director of the Department of health grant, renewal of the certificate of eligibility to practice for the forms of organization of medical practice, pharmacy, except in the form prescribed in paragraph 1 of this article.
The Department of Health established the Advisory Council with the participation of the medicine, pharmacology, Medical Council, provincial association of preventative medicine to consider and the Director of the Department of health grant or renewal of a certificate of eligibility to practice medicine, pharmacy.
Article 70.
1. The certificate of eligible private medical practitioners is sent and stored as follows: certificate of eligible private medical practitioners by the Minister or by the Medical Director of the Health Department grants are made in two versions: 1 a save at the Ministry of health (if issued by the Minister of health) or the Department of health (if by the Director of the Department of health level) , 1 a proposed basis for the certification of eligibility to practice medicine privately.

Article 71. The evaluation of the condition of the basis of medical practice, the private pharmacy must comply with the following procedures: 1. the establishment of the mission.
2. Conducting evaluation directly at the facility where the proposal evaluation. The assessment must ensure the following requirements: a) check the condition of the Organization, personnel, conditions for those who do the work of specialized facilities;
b) check the condition of the equipment, the facilities in accordance with the provisions of this circular, depending on the Organization Forms of practice suggest evaluators.
3. Set the minutes of the appraisal (according to the model of annex 5). Within minutes the appraisal must specify the scope of practice of the basis of assessment to be based on the actual capacity of the manpower, facilities, equipment of that facility.
4. Within 30 days from the date of the evaluation, the Evaluation Group minutes of the appraisal up leadership of the Ministry of health or the Department of health to review the granting or not granting certificates of qualified medical practitioners, the private pharmacy.
ITEM C-PROFILE, procedures and ISSUED PERMITS for FOREIGNERS WORKING in medical INSTITUTIONS, PRIVATE TRADITIONAL medicine Article 72. Profile, procedures: 1. Profile: a) petition work in health establishments, private traditional medicine;
b) copy of qualifications;
c) a copy of the certificate in legal practice or have certification of practice on 3 years of the country where that person citizenship or where people live and work in the long term;
d) legitimate copies of the certificate of eligibility of medical practice, the private pharmacy of labour hire basis;
DD) text of the provincial people's Committee, the central cities allowing dispensaries to hire foreign labor; Work permit by the Department of labour, invalids and social level for workers working on the area of the management;
e) resume self;
g) criminal record be the competent authorities of the country;
h) health and confirm healthy enough to practice of examination and treatment establishments from the district;
I) for direct examination and treatment didn't know Vietnamese must enclose the profile of translator include:-a copy of legally qualified;
-Copy of foreign language university diploma or certificate level C language;
-Curriculum vitae;
k) Have 2 portrait size 4 cm x 6 cm. 2. Procedure: a) the suggested profile are working in private medical establishments sent about treatment-Ministry of health;
b) records suggest was work in traditional medicine base send about traditional medicine-Ministry of health;
Article 73. The authority allows foreigners to do the work expertise in the medical facility, the private traditional medicine.

1. within 30 days from the date of the application, treatment must coordinate with the Service, Bureau, the relevant units to organize the evaluation of qualifications of foreigners suggest be done in private medical establishments and the Minister of health to review decision.
2. within 30 days from the date of the application, the Legal Service of traditional medicine are coordinating with the Service, Bureau, the relevant units to organize the evaluation of qualifications of foreigners suggest be done in traditional medicine base and the Minister of health to review decision.
3. where no license for foreigners who are doing the work professionally in the medical facility, the private traditional medicine must have a written reply stating the reason.
4. The Ministry of Health held the Council with the participation of the Medical Association, Vietnam, the Oriental medicine Pharmacology Vietnam to advise the Minister of health in the review, the decision for foreigners to work in the professional medical institutions, private traditional medicine.
ITEM D PRACTISING CERTIFICATE REVOCATION, CERTIFICATE of QUALIFIED medical practice, a PRIVATE PHARMACY Article 74.
1. The certificate of medical practice, private medicine is revoked in the following cases: a) the certificate of practice issued do not properly authorized;
b) Who are practising certificate but then again in one of the cases specified in article 6 of the Ordinance on medical practice, pharmacy private;
c) Who are practising the death certificate;
d) other circumstances as stipulated by law.
2. The certificate of qualified medical practitioners, the private drug withdrawn in the following cases: a) the head of the facility or the professional manager of the basis of medical practice, there is no private pharmaceutical practice;
b) certificate of qualified medical practitioners, the private pharmacy granted vires;
c) basis of medical practice, private medicine does not guarantee the conditions prescribed by the Ministry of health;
d) after 12 months from the date of the eligibility certification of medical practice, drug establishments to private medical practice, private medicine does not work;
DD) basis of medical practice, the private pharmacy bankrupt or dissolved;
e) other circumstances as stipulated by law.
3. the competent authorities practising certificate, the certificate of eligible private medical practice has the right to revoke the certificate of practice with respect to the case prescribed in clause 1 and 2 of this Article.
Article 75. The license granted to foreigners for professional work in the foundations of medical practice, private medicine is revoked in the event of that person being the competent State agencies of Vietnam ordered the expulsion or criminal processing.
CHAPTER VI CHECKING, inspection and HANDLING of breach of article 76. 
1. Service treatment, traditional medicine, equipment and medical works, Vietnam drug administration, Department of preventive medicine and HIV/AIDS in the function, tasks in cooperation with the Service, the relevant Bureau, Ministry of health inspectors to check, inspection of medical practice , the private pharmacy nationwide.

Article 79.
